All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Tommy Colbert clycolbert@aol.com June 23, 2011, 5:53 pm Source: N C Archives Written: 1793 Williams, John estate, 1793, Petition of Mourning Williams to Nov Ct 1793 states that her husband John Williams died about the month of August last seized and possessed of a considerable tract real estate and personal property, real estate consisting of lands to the amount of 1786 acres on Town Creek, one tract adjoining the lands of George Gardner, dec’d, Martin Gardner, (Hardy) Flowers & Benjamin Williford, another tract adjoining the said (Hardy) Flowers, the lands of (Hardy) Todd and Barnabay (Barns) and personal property consisting of three Negroes, ( ) of (Newbandry) Household furniture, carts, horses, stock and other articles to the amount of two thousand pounds and upwards; that said John Williams made a will in which some dispositions were made to her but inadequate for her support and she asks for her dower and personal property as set forth by law, signed ( ) attorney for petitioner; marked Mourning Williams vs Jno. Williams, executor. Commissioners lay off dower land to Mourning Williams, widow of John Williams, beginning at a dead pine standing in Bradley’s line then north 80 poles to a gum standing in Town Creek on the south side then up the various courses of said creek to a gum standing in the mouth of Rooty Branch then up the various courses of said branch to the fork then up the HogPen Branch prong to a maple standing in the back line then east to the first station, containing 59 & 1/3 acres which we find to be her part of the land allotted to Elizabeth Williams, wife of J.L. Batts, known as the Proctor tract being on the south side of Town Creek 21 July 1795, signed (James) Hanbury (X), Jas Draughon (X), Wm. Shuffield (X), Josiah (Isham) (X), Frederick Phillips, County Surveyor, (Rd) Harrison, Shf. NOTE: THIS LAND APPEARS TO BE THAT OF BETSEY MENTIONED IN WILL. Commissioners lay off dower land to Mourning Williams, widow of William Williams, dec’d, her dower or part of land her husband died seized and possessed of and also to allot her part of the personal estate of said dec’d, find that dec’d possessed about 812 & 3/4 acres of land lying on the north side of Town Creek including the plantation whereon dec’d usually dwelt out of which we allotted to said widow all that part of the plantation and land lying on the lower side of the road which we judge to be equal part or dower of that part of said land lying on the north side of the creek aforementioned; her dower on the south side of the said creek we have not allotted or laid out but are of opinion that she is entitled to dower in it as the part allotted on the north side of the creek is only what we can conceive she ought by law to have her dower in lying on that side said creek, we find that dec’d bequeath to his son, Benjamin Williams one horse valued at 20 pounds, one do called Brandy to Mary Lancaster, wife of Robt. Lancaster valued at ten pounds, three head of sheep to said Lancaster valued at 15 shillings, one Negro man Joe to his daughter, Elizabeth valued 120 pounds, one Negro woman named Celoe & child to his daughter Lucey, now wife of John Bell valued at 125 pounds, two cows & calves, one bed and furniture to his daughter Elizabeth at 17 pounds 10 shillings, to the widow 5 cows & calves, 17 pounds 15 shillings, two, two year old stears 4 pounds, ten 2 year old hogs at 10 pounds, ten year old do at 6 pounds 10 shillings, 3 sows and piggs at 3 pounds, 1 mare called pigeon at 8 pounds, 2 beds and furniture at 15 pounds, 2 pewter dishes, 4 basons, 6 plates & a case knife and forks at 3 pounds, 7 shillings, 6 pence, 1 chest, 2 iron potts and one iron kettle at 3 pounds & 15 shillings, 1 table 1 cart and wheels , 1 grubbing and 2 plow hoes, 1 woollen and a flax wheel at 3 pounds, 6 sheep & 6 chairs at 3 pounds, 16 shillings, making in the whole amount 373 pounds 14 shillings, 6 pence given this 24th day of July 1794, signed Willis McDade (X), Rennison Tisdale (R), James Drawhon (mark), James Merritt, Willm. Commissioners lay off to Mourning Williams, widow of John Williams, her dower interest in the lands lying on the south side of Town Creek containing 294 acres which was granted to John Williams, beginning at a red oak the first station in the patten then south 100 poles along the said patent line to a (poast) oak then west 151 poles to a pine then north 100 poles to a pine standing in the patent line then east along the old line to the beginning containing 98 acres, being one third of the above mentioned tract, 10 Dec 1795, signed Josiah (Shetgale), Martin Garner (mark), John Griffis (X), Joseph Pitt, James Drawhorn (mark), Daniel Futral, Hardy Coleman (H), Zadoc Braswell, Lazarus Flowers (mark), Jesse Gray, James Barnes (X), William Rogers, Frederick Philips, Cty sur, Rickd. Harrison, shf. COURT ORDER to sheriff of Pitt County to collect the sum of 203 pounds, 6 shillings and 8 pence from the lands of John Williams dec’d in the hands of Richard Williams, administrator, which Benjamin Philips lately recovered in Edgecombe County court, and 3 pounds, 9 shillings, 9 pence costs, signed 24 Nov 1806, E. Hall, CC. Another order to Pitt Co. sheriff for the above sums and reason ordered on 23 Feb 1807. A third order for same dated May Ct. 1807COURT ORDER to sheriff of Edgecombe County to hold Joseph Ross, Merchant for Feb Ct. next to answer charges that he owes the John Williams, executor of the estate of John Williams, dec’d, (not clear what amount, two figures stated), 6 Nov 1794. COURT ORDER to sheriff to appoint commissioners to lay off for Mourning Williams her dower in certain lands which her husband, John Williams died seized and possessed of, as well as her portion of the personal estate of said John Williams, dated 26 May (1794). COURT ORDER to sheriff to appoint a commission lay off and allot to Mourning Williams her dower in the lands that her late husband, John Williams died seized and possessed of, except the land claimed by the heirs of Jesse Williams and make report to next court, signed Edward Hall, CC, 6 Nov 1795.
