Summons to B.H. Bunn to appear in W.T. Gay's office on 25 Sept 1873 to answer the complaint of Finettie Williams for the non-payment of $160.64, witnesses summoned were Jesse ( ), Abner Braswell, P.C. Petition to sell land, Sallie Stokes & her husband, Thomas Stokes, W.R. Williams, Mollie Price and her husband, Orphy Price, Mack Williams, Jimmy Williams & Cally Williams state that Whit Williams died intestate about the year 1873 seized and possessed of a tract of land that was divided under a court order and one tract was assigned to Mike Williams and his heirs; said Mike Williams being a son of said Whit Williams and tract of land was adjoining the lands of Fred Proctor, dec'd, Jos. Long, Pollie Robbins and others, containing 23 acres; said Mike Williams died about two years ago leaving the following children and heirs at law: Sallie Stokes, wife of Thomas Stokes, she is 30 years old and resides in Nash Co; Wm. R. Williams who is 26 or 27 years old and resides in Nash Co; Mollie Price, wife of Orphy Price, she is 223 years old and resides in Nash Co; Mack Williams who is 22 years old and lives in Nash Co; Jimmy Williams who is 19 years old and lives in Nash Co. with R.D. Stallings; Cally Williams, a girl of 17 years who resides in Nash Co. with her sister, Mrs. Thomas Stokes; the infant, Jimmy Williams will be 21 years of age on 17 March (1887); the infant Callie Williams will be 21 years on 16 Aug. 1889; the said parties are tenants in common, each being entitled to one sixth of the 23 acres; owing to the small size of the tract, it is in the best interest of the parties to sell the tract and divide the proceeds, expected to be about $175, should be divided among the them, signed Bunn & Battle, attorneys and W.R. Williams, one of petitioners. Infants James Williams and Callie Williams ask court to appoint T.P. Braswell as their next friend, signed J.M. Williams, Callie Williams. W.D. Stokes is sworn and states that he thinks T.P. Braswell is competent and suitable to act as guardian of James Williams and Callie Williams, signed W.D. Stokes. T.P. Braswell agrees to act as guardian. Signed T.P. Braswell. W.D. Stokes and A.C. Thomas state that they are well acquainted with the land and that due to the small size of the tract and the fact that only 10 or 12 acres are cleared, it could not be divided fairly. Jacob Battle, was appointed to sell the land and did so on 2 Feb 1886 for the sum of $191 to N.P. Bullock at public auction. After deducting expenses, each of the heirs received $26.70. Mack Williams and Orphy and Mollie Price receipted for their shares on May 27, 1886; W.R. Williams receipted for his share on May 18, 1886; Thomas and Sallie Stokes receipted for her share on June 5, 1886, Jas. M. Williams receipted for his share on March 18, 1887; he was 21 on March 17, 1887 and received his share and interest, totaling $28.50; Callie Williams receipted for her share on Dec. 20, 1889, she was 21 on Aug. 16, 1889 and received her share plus interest, totaling $32.89. Gay, T.H. Griffin, J.A. Jackson, A.W. Jackson, Joe Long, B. Freeman, A. Daughtridge, M.E. Robbins, Jesse Brake, E. Thomas, J.E. Calhoun, J.N. Taylor, S.H. Hargrove, M. Williams, Aney Long, W.W. Parker, A. Braswell, J.C. Robbins, J.L. Boon, W.M. Proctor, Mike Williams, W.J. Calhoun, and John Freeman. At another sale held on 2 Jan 1874 buyers included the widow, R.S. Petway, Theo Lee, A. Braswell, W.B. Bradley, Bennett Gay, A. Bullock, T. Lee and J.W. Freeman. This sale totaled $251.34. In addition to sales, 1457 pounds of cotton was shipped to A.T.
