Forsyth County (038) 1865 WB-1/257-AR (NC Archives) (Mitchell Index) W--180 741- 744 In the name of God, Amen, I Peter Pfaff , of the County of Stokes and State of North Carolina, being of sound mind and memory, but considering the uncertainty of my earthy existence, do make and publish this my last will and Testament, in manner and form following that is to say 1. That my Executors (herein after named) shall provide for my body a decent Christian burial suitable to the wishes of my relations and friends, and pay all funeral expenses, together with my just debts howsoever and to whomsoever owing out of the money that may first come into their hands as a part or parcel of my estate. 2. I will unto my beloved wife Anna Magdalena the house wherein and in which I now live, and also half of my garden-her choice, and other truck patches as many as she may want, for her own use, and where she wants them, on the land herinafter willed to my son Peter Edwin. All the above willed to my wife during her life-time, and after her death I will it to my son Peter Edwin. And I also will to my said wife six hundred dollars in cash, paid to her by my executors, also one cow-her choice, also my one-horse wagon, with plantation and carriage body, two sheep, her choice, one sow-her choice, also two beds and furniture-her choice, also one bureau, also my house clock and case, one looking-glass, also my large bible, cooking utensils, plates, cups, saucers, knives, forks and crockery ware, as much of them all as she wants, also one set of flatirons, one flax-wheel and one big wheel, one pair of cotton cards and reel, one wash-tub, my large wash kettle. And I also will that my said wife have one year's provision, as follows: Sixty bushels of wheat, one hundred bushels of corn, six choice hogs, or eight hundred weight of pork, fifty pounds of laird, eighty pounds of coffee, fifty pounds of sugar, one beef, two pounds of pepper, two pounds of allspice, one pound of ginger, all cotton and flax on hand at my death, and all the thread on hand, all the soap on hand, all the vinegar on hand and the keg, and two pair of shoes. 3. I will unto my son Solomon a certain tract of land known by the name of Charles Holder Tract, adjoining Philip Transou and Ephraim Transou, also the tract whereon the said Solomon now lives, bounded on the north by the Old Town road, on the west by Christian Pfaff, on the South by a new division line between said Solomon and my son Peter Edwin, which I had run heretofore as a division line between the two said sons, west by the same division line, including also the lands of said boundaries, also Twenty-two acres of the north end of a tract of land on Buffaloe Branch, And the said Solomon is to account to my Estate for the above lands at the sum of Four Hundred and eight Dollars. 4. I will to my son Peter Edwin the remaining part of my home tract of land, and the remaining part of my Buffaloe branch tract, and for the above lands the said Peter Edwin is to account to my Estate at the sum of Four Hundred and fifty Dollars. And I also will to my son Peter Edwin one sorrel mare, he now claims also the saddle; bridle and saddle blanket he now claims, also one cow, also one bed and furniture. 5. I will to my son Philip Henry a certain tract of land known by the name of John Krause's place, adjoining Benjamin Pfaff and Joseph Conrad's lands, on Muddy Creek, for which lands said Philip Henry is to account to my Estate at the sum of Three Hundred and Sixty Dollars. 6. I will to my beloved wife my negro woman Matilda, and her daughter Sarah Ann, and all her increase as long as wants them, but after her death all said negroes are to fall back to my Estate, and by her consent at any time. My Executors shall sell them or any of them privately to a good master, but not to a trader, and the proceeds of said negroes shall be divided between all my children, share and share alike. 7. I will that my negro man Elijah shall be sold privately by my Executors to the best advantage to a good master, but not to a trader, and if said executors cannot sell said negroe to advantage, they are at liberty to hire him out privately until they can sell him, and the proceeds of the hire shall be divided between all my children-share and share alike, and after said negro is sold, and the money collected, share and share alike-the same as the hire. 8. I will that my lime-kiln and tract of land belonging thereto shall be rented out by the kiln, and my executors may let the renter take two kilns, if they think proper-the kiln to be put up to the highest bidder, after being advertised at three or more public places in the neighborhood of said kiln for at least fifteen days, each time of renting. The said lime-kiln is to be rented for ten years, and after the expiration of the ten years the said kiln and land is to be sold at public sale by my executors, on a credit of twelve months. 9. I will that the proceeds of the two first lime-kilns that are to be rented shall be divided and paid over to my four daughters: viz. Katharine, Mary, Lavina and Henrietta eqal share and share alike. This to make my daughters equal in all advancements, and after the two first kilns the rent and sale of said kiln is to be divided between my wife and children-share and share alike. 10. I will that my part in the oil-mill and the land belonging thereto shall be sold by my executors at public sale. And also my shares in the "Salem Cotton Factory are to be sold by my executors at public sale, and the proceeds of both oil mill and Factory stock shall be divided between my children-share and share alike. 11. I will that my grand-child Emma Pfaff shall have one bed and furniture, one bureau, one cow, one flax wheel and one big wheel, one dress, a bonnet and a pair of shoes, and Ten Dollars in cash. I will that the above be furnished the said Emma Pfaff by my wife out of what I have herein willed to her. 12. I will that the balance of my property belonging to my Estate shall be sold at public sale by my executors on a credit of Twelve months. I have deeds ready written and signed in my possession, for all the lands herein before willed to my sons Solomon Philip and Peter Edwin, which are to be delivered to said sons by my executors at the settlement of my estate. 13. I will that my executors have power and are hereby empowered to make good Deeds to all my Lands that are above named, to be sold by them, and that at the final settlement of my estate, I will that all my children share and share alike in said division. Putting full confidence in my son Solomon and my son Nathaniel, I do hereby appoint them as my Executors, Hereby revoking and declaring utterly void all other Wills and Testaments by me hertofore made. In Witness whereof, I the said Peter Pfaff as hereunto set my hand and seal, this 22nd day of April, A.D. 1847.
