All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Susan Davis sdavis124@msn.com July 23, 2009, 7:21 pm Source: Franklin County, Nc Written: 1874 Book 40 Pages 233-234 This indenture made the 24th day of January in the year of our Lord 1874 between W I Harris and wife Mollie A Harris of the first part, and Ambrose Upchurch of the second part, all of the County of Franklin & State of N Carolina Witnesseth: that the said W I Harris & wife Mollie A Harris for and in consideration of the sum of one thousand dollars in kind paid by the said Ambrose Upchurch has bargained and by these present dost grant bargain sell and convey to the said Ambrose Upchurch his heirs & assigns the right and title conveyed to use by the said Ambrose Upchurch and Sheriff E.A. Guyton of Franklin County, North Carolina a certain tract or parcel of land where the said Ambrose Upchurch, now fives, containing three hundred & ninety one acres more or less adjoining the lands of Shaw Driver, Mary Massey, B.T. Strickland and others with all and every the appurtinances thereto belonging or in any wise appertaining that have heretofore been conveyed to him by the said Ambrose Upchurch that I have before the ___ of this deed, full right absolute and lawful authority to sell the said land and promises as conveyed to one by the said Ambrose Upchurch & E A Gupton Sheriff of Franklin leave by for whichto convey by right and title to the said Ambrose Upchurch his heirs and assigns forever, in witness whereof I set my hand an seal the day and date above written. Signed, sealed and delivered in the presents of F.P. Pierce W.I Harris seal Mary A. Harris seal State of North Carolina Franklin County Whereas Ambrose Upchurch hath produced a deed of conveyance made to him from W. I. Harris and Mollie A. Harris his wife of a certain tract of parcel of land lying and being in the County of Franklin in the said State and procured the execution of the same to be by theirs signed or acknowledged and the same having been proved by the Oath of F.P. Pearce ag to W.I Harris one of the grantors of said County and it being represented to our said Court that it is required by law that Mollie A. Harris wife of the said W. I. Harris he is _____ privily as to her free consent in executing the said Conveyance. Know ye, that supposing confidence in your providence I have appointed you and by these presents do give unto you power and authority to take the private examination of the said Mollie Harris wife of the said W.I. Harris concerning her free consent in executing the said conveyance, and I therefore command you that such certainty and place as you shall think fit you to the said Mollie A Harris if she cannot conveniently come to you and privily and apart from her said husband examine her whether she executed the said conveyance freely and of her own accord and without fear or compulsion of her husband, and when you have taken the examination you are to send the same closed under your seal together without this commission to our said Court of Probate. Witness, R. H. Timberlake Judge of Probate of said County at office this 15th day of January 1874. Personally appeared before me F.P Pierce, Justice of the Peace of Franklin County, Mary A. Harris wife of W. I Harris and acknowledged the due execution of the foregoing deed of conveyance and the said Mary A. Harris being by our privately examined, separate and apart from her said husband touching her voluntary executive of the same doth state that she signed the same freely and voluntarily without fear or compulsion from her said husband or any other person, and that she doth still voluntarily assent thereto.
