Now therefore we Mary Ann Massey widow of Patan Massey, Candis Upchurch widow of John Upchurch, Charlotte Evins wife of Hinton and William J Stallings son of Joseph Stallings dec'd, we being the ownly heirs at law of the said James Stallings and are managing for themselves do mutually agree with each other to divide the aforesaid ninety-five acres of land equally by agreement between ourselves by a survey and plot made by F P Pearce on 8th day of December 1879 into the following lots No 1 23 acres No 2 25 acres No 3 23 and No 4 24 acres and divided by agreement as follows William J Stallings take lot No 1 twenty three acres Candis Upchurch takes lot No 2 twenty five acres Mary Ann Massey takes lot No 3 twenty three acres and Charlotte Evins wife of Hinton Evins lot No 4 twenty four acres and pays over to William J Stallings four dollars and fifty-nine cents difference in valuation. Now we Mary Ann Massey, Candis Upchurch, Hinton Evins and wife Charlotte, and William J Stallings do bind ourselves as heirs and assigns in the sum of two hundred dollars each to be levied of goods and chattels lands and tenements to void on condition that we and each of our heirs and assigns do stand to and abide the above division of said land then this obligation is to be void otherwise to remain in full force and effect.
