All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beverly Watson beverly_wat@msn.com November 5, 2010, 6:16 pm Written: June 13, 1838 Recorded: June 16, 1838 Deed Book 27, Page 487 13 Jun 1838 This Indenture made and entered into this 13th day of June 1838 between William Reaves of the first part Peter Foster and Jason Goswick of the second part and David Young of the third part all of the County of Franklin and State of North Carolina Witnesseth that whereas the said Reaves of the first part stands justly indebted to the said Peter Foster with the said Jason Goswick jointly (?) in the just and full sum of One hundred & Sixty three Dollars 84/100 up to this day reference to Two notes given to the said Peter Foster the 20th of July 1837 will fully show Amounting to One hundred & forty-seven dollars 55/100 upon which the said Reaves & Goswick are Sued (?) to June Court 1838 And consequently enhances the debt including interest and cost to the sum of one hundred and Sixty-three Dollars 64/100 now for an in consideration of the premises and the further consideration of one dollar to the said Reaves in hand paid by the said Davis Young the receipt whereof is hereby acknowledged the said William Reaves doth Bargain sell alien enfeof and confirm unto the said Davis Young his heirs and assigns forever a certain Tract or parcel of land whereon Richard Reaves now lives containing One hundred & Twenty Acres more or less adjoining the land of Samuel Harris Fenner Young & others To have and to hold to him the said Young his heirs and assigns forever And the said William Reaves binds himself his heirs Executors Administrators or assigns to warrant and forever defend the Right and Title to the aforesaid Tract of land to the said Davis Young his heirs Executors administrators or assigns forever - In Trust nevertheless and upon the following condition that should the said Jason Goswick who is now the only person Sued (?) on said claim not be released immediately by the said Reaves from any liability or subjection to the payment of said debt that then the said Davis Young at the request of the said Jason Goswick Tuesday in an September Court week next proceed to sell the said land to the highest bidder for cash or otherwise as he may be directed and with the money arising from such sale pay the aforesaid debt due Peter Foster as aforesaid and all cost and charges in carrying this trust into execution and the balance of the purchase money of any after paying the aforesaid debt the said Young agrees to pay the same to the said Reaves or his order or assigns. Young PR Additional Comments: Deed of Trust from William Reaves to Davis Young, for a debt owed to Peter Foster by Jason Goswick and William Reaves. This was a parcel of land where Richard Reaves, father of William Reaves, was living at the time. In 1846, recorded in Deed Book 29 at page 386, Mildred Reaves and Mary Reaves, widow of Richard Reaves, buy this land back from Jason Goswick.
