Franklin County, NC - Will of Jacob Hartsfield (1737-1814) ~~~~~~~~~~~~~~~~~~ Heartsfield of the County of Franklin and State of Northcarolina having my natural Reason & memry but knowing the mortality of my body and that it is appointed for men once to die I do here by -in this my last will & testament in manner and form following that is to say what worly substance God to bestow upon me after paying all my lawful Debts I leav in the following manner --- -queath to my son Andrew Heartsfield all the land & improvements on crooked Creek wheron I now live named Buck & one named Hanner & her child named Elick on feather bed & furniture -eath unto my Executors & the survivors of them & the Executors or administrators of the survivors the following -rty to wit, a Negro named Easter & one man named tom a feather bed & furniture & one fifth of the Remaining my Estate that I have not nor shall hereafter Dispose of. In trust for the sole & separate use of my Elizabeth the wife of Bery White During the time she shall Remain Married to her said Husband -aid property being in any manner subject to the control or disposal of her said Husband or subject if my said Daughter Elizabeth should survive her said Husband then I give the said property her & her heirs for ever but if my said Daughter should die During the life of her said husband -l and desire is that the said property shall be Equally Devided between all her Children then living -f her childrend should die in the life time of their Mothere leaving a Child or children the said Child -n shall be entitled to their Deceased parents share. I leave & bequeath to Roeny Harris one Negro named leave & bequeath to Elizabeth Arendell one Negro name aron --- -ve & bequeath unto my Executors & the survivors of them & the Executors or Administrators of the survivors the following -erty to wit one Negro named mason, one named Amy, one named fanny, one named Enock, one feather bed & -niture one Rone mare of tarvors Horses geting four cows & calves with the fifth of the remaining part of my Estate have not nor shall hearafter Dispose of, In turst for the sole & separate use of My Daugther wife of Edward Cooley During the time she shall Remain Married to her said husband without -roperty being in any manner subject to the control or Disposal of her said Husband or -is Debts, and if my said Daughter Delilah should survive her said husband then I give the said -olutlely to her and her Heirs for Ever, but if my said Daughter should Die During the life of her then my will and Desire is that the said property shall be Equally De\ivided between her children & if any of her children should Die in the lifetime of ther mother leaving a child or children -ld or chldren shall be intitled to ther Deceased parrents sheare --- beuath unto my Executors & the survivors of them & the Executors or adminstrators of the survivers the following -perty to wit one Negro named Lewis one named Abrim one name Lilly on named a feather bed & furniture with the fift of Remaining part of my Estate that I have not nor shall here -er Dispose of in trust for the sole & seperate use of my Daughter Marthy wife of Jerimiah Perry Ridg -ing the time she shall Reamin Married to her said Husband with out the said property being in any subject to the control or Disposal of her said Husband or subject to pay his Debts and if my said Marthy should survive her said husband then I give the said property absolutely to her & her -n, but if my said Daugther should Die during the life of her said Husband then my will & -at the sd. property shall be Equally Devided between her children then living and if any of -hildren should die in the life time of ther mother leaving a child or children the said child -ldren shall be intitled to ther Deceased parents share. --- & bequeath to my daugtyher sarah Hunt a Negro named Baltimore & one named Harmon are willing to g Tennisee & if they are not willing to go my Desire is that thay be not forsed thay may be Valued by men that is not Intrusted, and my son Andrew to take them at ther Value & money to Sarah Hunt with in twelve months or soner if he convenantly can, if he is willing if he is not Willing to take them my Desire is that he may hire or sell them to some Nobourhood where I now live that he may have Reason to think will treet them well thay hire or sell for to Sarah Hunt one feather bed & furniture one Hundred Dollars of the Estate the fift of the Remaing part of my Estate that I have not nor shal here after Dispose of I leave & bequeath to my Daughter Mary Perry Shocko one Negro named Richman one named Ish- named Sidy & her two children named Osburn & kilessel & lucy a feather bed & furnitur- and the fifth of the Remaining part of my Estate that I have not nor shall here after Disp- I leave & bequeath to Micajah Mickelroy three Hundred & fifty Doller to be Rassed out of the Negroes that hav not been mentioned before Cook Will Jane & fevibe I Desire they may be Inspection & Direction of my Executors to order them as thay think best, only I Disire thay may no- but with what thay can do be supported out of the Estate, and that my Executors may keep anough Hands to do it and pay them selves for ther trouble --- and if any Dispute should arise with andy of the legitees a bout the Estate I Desire the- be any lawsuet aobut it, but that thay chuse thirteen good and lawful men that is or Related to any of them & a majority of them to Decide it ---- & I here by appoint My son Andrew Heartsfield & Shocko Jerimiah Perry Executer my last will and testament Revoking all former wills by me made and Declaing be my only last will and testament In witness where of I have heare unto set my han- This June the 9 day 1813 signed sealed and deliver} Jacob Heartsfield {seal} in presence of } Test } Arendell } William Arendell } Nathaniel Macmullen } Benjamin Mathews } [following notes by Eric Hartsfield, 6 May 2004] Jacob Hartsfield bequeathed to 1.
