Bennett Hills Will Recorded in Book A folio 167. In the name of God Amen. I BENNETT HILL of Franklin County & state of North Carolina being in health of body & of sound mind & Memory for which blessing I thank God also considering the uncertainty of this life do make & ordain this my last Will & testament in manner & form following Item I commend my soul to God who gave it hoping for a happy resurrection through the merits of my __ Savior, my body to be decently buried at the discretion of my Executor and as to my worldly estate I give in the following manner Item It is my will & desire that all my just Debts be paid and that my Executor sell a tract of land lying in ___ County west of the Mountains and such other part of my estate as they may think proper sufficient to discharge the same without an order of Court. Item I give devise and bequeath to my sons to them & their Heirs forever all my lands in Franklin County and one other tract in Northampton County adjoining POLLOCK to be equally divided among them by three men to be appointed by my Executor for that purpose. Item My will and desire is that after my Just Debts are paid that my wife MARTHA HILL keep the whole of my estate both real and personal together for the purpose of raising, clothing & schooling my children & maintenance o herself and children until she shall marry & in case she shall marry my will & desire is that my wife MARTHA HILL draw an equal part of my personal estate with my children then living to her & her heirs for ever and that the remaining part of personal estate continue together in one stock for the benefit of my children till the oldest child survives to lawful age or either of them marry then my will & desire is that the part of my estate then being undivided shall be divided into as many lots as there shall be children living & such child arriving to lawfull age or marrying to draw an equal part with the other child as their portion of my personal estate to them & their Heirs for ever & then the remainder to revert into one stock to be divided & drawn for by lots as the rest of the children shall marry or come of age, in the manner as before mentioned. Item My will & desire is that my wife MARTHA HILL have the use of my Dwelling House with the out houses together with fifty acres of land adjoining thereto also one hundred acres of land that I purchased of MRS. ANN CUPPLE during her widowhood. Item Also I nominate and appoint my friends JORDAN HILL & JOHN THOMAS, Executors & my wife MARTHA HILL Executrix to this my last will and testament hereby revoking all others.
