Franklin County, NC - Will of Reuben Stallings, 1846 ~~~~~~~~~~~~~~~~~~~~~ Reuben Stallings of Franklin County, North Carolina Last Will and Testament August 20, 1846 In the name of God, Amen. I Reuben Stallings of the County of Franklin and State of North Carolina being weak in body, though sound in mind and disposing memory do think proper to make and ordain this to be my Last Will and Testament in manner and form following: (To Wit;) Item 1: It is my will that all the perishable property that I have in the possession of Alfred Lancaster an the tract of land he is now living on being the land that I purchased at public sale, be sold should it fail to bring enough money to pay off the amount that I am owing and bond for him the said Alfred Lancaster, it is my will that the old negroes man York, & Clary one or two of her children be sold, (The names of the three children of Clary are Emeline, Penuries, & Ellen), the amount to be raised from said sale will be between five hundred dollar and five hundred and fifty as will as my memory serves me. I give the balance of the said negroes & there increase not knowing which will be sold, together with what money should there be any balance left after paying off the above sum of five hundred or five hundred and fifty dollars, to the children of my daughter Frankey Lancaster, and to be equally divided between them. Item 2: It is my will and desire that the tract of land that I am now living on containing two hundred and thirteen acres more or less, together with the personal and perishable property of every description whatever be sold; and after paying my just debts, (out side of my debts as above stated) that I am owing for Alfred Lancaster, my will is that my beloved wife Winifred shall have one fifth, of the amount left after paying my debts as above stated which sum I give to her and heirs forever. Item 3: I give after deducting the one fifth, that I have given to my wife, the balance of the money, to be equally divided, between my sons John, Kemp, Edwin, William Henderson, Reuben, and the children of my son Abner to draw one share and be equally divided between them and their heirs. Lastly, I nominate and appoint my worthy friend Washington Harris, my executor to this my Last Will and Testament this 20th Day of August 1846.
