Franklin County, NC - Estate of Irving Stallings, 1862 ~~~~~~~~~~~~~~~~~~~~~ Irving Stallings of Franklin County, North Carolina Estate Records, Court of Pleas & Quarters Session September Term 1862 State of North Carolina } Court of Pleas & Quarters County of Franklin } Session September Term 1862 To the worshipful, the Justices of said Court the Petition of Mary Stallings, widow of Irving Stallings deceased. Humbly showith unto your worships that my late husband Irving Stallings departed this life intestate in the County of Franklin in the month of July last having your petitioner his widow and with the following children and one grand child, who are his heirs at law to wit: Alfred Stallings, Alex Stallings, Weldon Stallings, Jane Guilliam wife of James Guilliam, Mary Hollingsworth wife of Swickman Hollingsworth, Harriet King wife of Burrell King, Frances Stallings, wife of John Stallings, Susan Inscoe, wife of William Inscoe, Elizabeth Swanson, wife of William C. Swanson and Robert Stallings an infant child of Irving Stallings Jr. deceased for whom the said Alfred Stallings has been appointed guardian by this Court at its present term. Your petitioner further showith that her said husband died sized in fee of a tract of land in said County situated on Red Budd Creek adjoining the land of A.M. Bobbitt, Gray Stokes, Priscilla Leonard and others and containing by estimate six hundred acres upon which the said deceased resided and had his mansion hence and in which your petitioner as she advised is entitled to dower - And she prays your worships to grant her a writ of dower issued to the Sheriff of Franklin County commanding him to summons a Jury of good lawful men to lay off and allot to her dower in the said land and to put her in possession thereof and to make when thereof to the next term of this Court and to that end she prays that process may fine to the said heirs at law commanding them to be and appear and go forth hence shall ever Pray & C. James Stallings of Franklin County, North Carolina Nuncupative Last Will and Testament September 7, 1851 The following is the last will of James Stallings. I James Stallings as exculpated before us as witness on Sunday the 7th day of September A.D. 1857. To Wit: I wish Nickolas Arrington to have as agent appointed to settle my estate and the balance or residue to be divided equally between my brothers, Willie Stallings, William Stallings, and my sister, Maria Stallings Attest: Witness: James Collins B.
