Franklin County, NC - Will of Hilliard Stallings, 1856 Last Will and Testament 29 April 1856 In the name of God Amen; I Hilliard Stallings of the County of Franklin and State of North Carolina, being of sound mind do make and publish the following to be my last will and testament that is to say: Item first: I give and bequeath to my beloved wife Cornelia M Stallings the sum of one thousand five hundred dollars in money to be raised from sale of my estate. Item second: I give and bequeath to my son, C. Haywood Stallings, the tract of land whereon I now live and the improvements, to him and his heirs forever and absolutely. Item third: I give and bequeath to my son John M. Stallings, the tracts of land called the Boon and Stokes lands say about two hundred and thirty acres to him and his heirs forever absolutely. Item fourth: I give in trust to my son George W. Stallings the sum of three hundred dollars, making my son C. Haywood Stallings trustee and to be paid over to son G.W. Stallings in such sum or sums as he might deem best making the trustee. Item fifth: I give and bequeath unto my three youngest children (Viz) Oliver, Elizabeth, and Signora Stallings four hundred dollars each for the support and education of them over and above what I have given them in one other item below. Item sixth: I give and bequeath to my son Cornelius H. Stallings, Negro woman, Fanny and her future increase from the date of this will to him and his heirs forever. Item seventh: I give and bequeath to son John M. Stallings, Negro girl, Liza and her future increase from the date of this will to him and his heirs forever. Item eighth: After paying my just debts, I give and bequeath unto my five youngest children (Viz) Langdon, Rufus, Oliver, Elizabeth and Signora Stallings all the balance of my Estate, this is not disposed of above, say the following Negro Slaves and there increase from the date of this will (Viz) Andrew, Abram, Patty, Chany, Silas, Anny, Albert, Serena, Maria, Clary, Phil, Paul, William, Isabella, John, Hannah, Elizabeth, Fanny, Sarah, Margaret and Gilbert to them and their heirs forever, also the cash of the proceeds of the sales of the crops, stock, and household and kitchen furniture and all balances of money or affects should there be any after the paying my debts, and the sums above specified to be raised out of my estate. Lastly I nominate and appoint my sons C. Haywood and John M. Stallings and Wilson D. Webb sole executors to this my last will and testament hereby revoking all other wills and testaments Whereof I have to this last will set my hand and affixed my seal this 29th day of April 1856. Hilliard Stallings first marriage was to Emily Daniel and the children mention were by her. The wife mentioned in his will was Cornelia M. Edwards who later married Rix Boone. The slaves mentioned in the inventory dated Sept 9, 1856 are Abram, Patty, Andrew, Chany, Fanny, Hannah, Eliza, John, Anny, Paul, Silas, Albert, Phil, William, Gilbert, Mariah, Serena, Clara, Sarah, Margaret, and Isabella. ______________________________________________________________________ Copyright.
