Page 1 I Solomon Rhyne of the County of Gaston and State of North Carolina being of sound mind and memory but considering the uncertainty of my Earthly Existence do make and declare this my last will & Testament in manner & form following. That is to say First That my Executor (hereinafter named) shall provide for my Body a decent Burial suitable to the wishes of my relations and friends & pay all Funeral Expenses together with all my just debts howsoever & to whomsoever owing out of the Moneys that may first come into their hands as a part or parcel of my Estate. Item I give and devise to my beloved wife Elizabeth Rhyne the plantation on which I now live together with all my negroes, Horses, Mules, Cows, hogs, Sheep, farming tools household & Kitchen furniture and every other Species of property that I own or am in possession of at the time of my death. To have & to hold the same to her the Said Elizabeth Rhyne for & during the Time of her natural life or widowhood. Item After the death or marriage of my wife (in the case She Should marry again) my will and desire is that the plantation on which I now live be Equally divided between my two Sons Miles A. & Henry M. Rhyne & in the Event that my Son Miles Should die before me then & in that case his portion of the said Tract of land is to Fall Back & become a part of my Estate for division as my other property herein after named. Page 2 Item I give and bequeath to my Son John H. Rhyne (now living in Wadesborough N.C.) one Cow & Calf in order to make him partially Equal to the advancements I made to my other Children. Item I give & bequeath to my two daughters Louisa Clemmer wife of Adam Clemmer and Margaret Summy wife of Jonas Summy all the Beds & other clothing of which my wife & myself may be in possession at the time of her death. Item My will and desire is that all the residue of my Estate after taking out the devises & legacies above mentioned Shall be Sold & the debts owing to me collected and the Entire amount be divided into Ten Equal Shares which my Executors (hereinafter named) Shall pay over to my Children in the following manner (after deducting the Sum of three hundred dollars from the Share of my Son Michael P. Rhyne which Sum is to be Equally divided between my other nine Children or their legal representatives) one tenth to the heirs of My Son Simon P. Rhyne (who is now dead) with the one ninth of the sum deducted from M. P. Rhynes Share which is thirty three & 33/100 dollars & my will & desire is that Maria Cann Said S. P. Rhynes daughter by his first wife Riceive four times as mutch of Said Share as any of his other childrun provided She has Issue or a child or childrun but in the event that She does not have a child or children then her part is to fall Back into my estate & be divided amongst my other Children. Page 3 One tenth to my son D. W. Rhyne with thirty three & 33/100 dollars added one tenth to my Son John H. Rhyne with thirty three & 33/100 dollars added. One tenth less the aforesaid three hundred dollars to my Son M. P. Rhyne. One tenth to my Son Eli S. Rhyne with thirty three & 33/100 dollars added. One tenth to my Son Miles A. Rhyne with thirty three & 33/100 dollars added. One tenth to my Son Henry M. Rhyne with thirty three & 33/100 dollars added. One Tenth to my Son Jacob G. Rhyne with thirty three & 33/100 dollars added. One tenth to my Daughter Margaret Summy with thirty three & 33/100 dollars added. one tenth to my Daughter Louisa Clemmer with thirty three & 33/100 dollars added which said bequest is made strictly to her separate and apart from her husband Adam Clemmer who is to have no control over it in any way. And lastly I do hereby constitute & appoint my bloved Sons John H. Rhyne Miles A. Rhyne & Henry M.Rhyne my lawful Executors to all intents & purposes to Execute this my last will and testament according to the true intent & meaning of the same & every part & clause thereof hereby revoking & declaring utterly void all other wills & testaments by me heretofore made.
