John D. Pipkin & Others to the Court - Petition to Divide Land, 1840

State of North Carolina
Gates County
Court of Pleas & Quarter Sessions
May Term 1840

To the Worshipful Justices of the said Court
The petition of John D. Pipkin, Hennisy T. Smith & wife Martha and of Mary 
Pipkin shew your worships that Isaac Pipkin late of said county departed this 
life having made a last will and testament in due form of law to pass real 
estate by which he devises a tract of land therein mentioned to his two grand 
sons and that as to the residue of his real estate he devises one third to his 
wife Mary for her life and the residue to your other two petitioners equally to 
be divided between them; and after the death of said Mary he desires the third 
given to her to be equally divided between your other petitioners. They show 
your worships that said testator died seized of a large real estate lying in 
Gates County which they are anxious to divide between your petitioners according 
to the provisions of said wife. Your petitioners therefore pray your worships to 
appoint commissioners to divide said real estate among your petitioners and that 
they make a report to the next term of this court under their hands & seals.
