Gates County, NC - Will of Jacob Eason, 1831

LAST WILL AND TESTAMENT OF JACOB EASON 

Jacob Eason, Sr. (291-293) In the name of God Amen.  I Jacob Eason Senr. Of 
Gates County in North Carolina being of sound mind thanks be to God for the 
same do this 10th day of June in the year of our Lord 1830 make and publish 
this my last will and testament as follows.

First I lend unto my son Melton Eason during his life Eighty six acres of land 
in Gates County adjoing the land of the heirs of Seth Trotman and James Brinkley 
and after the death of my son Milton Eason I give the said land to be equilly 
divided among the children of my said son Milton Eason which I give to them and 
their heirs forever.

I give and bequeath to my son Whitmell Eason ninety acres of land adjoing the 
land of Willis Bunch and William Feltons heirs, one negro man Solomon, one negro 
girl named Vilot to him and to his heirs forever.

I give and bequeath to my son Jacob Eason, two hundred and fifty acres adjoing 
the land of Moses Hurdle and John Felton, one negro Boy named Adam, Girl Betty, 
and Elvy, woman Sarah, one brandy still and one set of Blacksmith tools, one 
horse, one mare named Nancy, one feather bed and furniture which I give to him 
and to his heirs forever.

I give to my daughter Sarah Benton Ten shillings to her and her heirs forever.

I give and to bequeath to the children of Robt Felton all the negroes that are 
now in possession of which I give to them and their heirs forever.

I give and bequeath to my my daughter Charlotte Eason the following negroes 
Tamer, Harry, Willis, Myles, Will, Rose, Junior, and Ellick, which I give to her 
and her heirs forever.

I have in the possession of my executor hereafter named the following negroes 
woman, Peggy and Cyntha, Boy Solomon and Girl Edith and for my daughter Treecy 
Spivey to have the use of heir of the said negroes during her life and after her 
death I give the above named Negroes to be equally divided between the children 
of my daughter Treacy Spivey which I give to them & their heirs forever.

I give and bequeath to my daughter Clarisa Trotman Negro woman Anneca girl Lydia, 
woman Junor and girl Harret, one horse, one cow and calf, one feather bed and 
furniture which I give to her and her heirs forever.

It is my will that my executor sell all the balance of my property of every kind 
not before given away and after paying my debts and othe expenses one seventh 
part for my executor to retain his hands as trustee for my daughter Sarah Benton 
to be expended by him as he may think proper for the Comfort and support of my 
said daughter Sarah Benton.

The balance of my estate I give to be divided among my six children Milton, 
Whitmell, Jacob, Charlotte, Treasy, and Clarisa, to them & their heirs forever.

I nominate Constitute and appoint my friend Henry Skinner of Perquimans County 
my whole and executor in witness wherof I have hereunto set my hand and seal the 
day and year written &c. Signed sealed and delivered in the presents of Wm R. 
Skinner, Joseph Brinn.

Disputed will of Jacob Eason Decd an issue made up under the direction of the 
Court to try the validity of the said will, and a Jury being Impannelled and 
sum to try the said issue to say that this paper writing exhibited to them 
purporting to be the last will and Testament of Jacob Eason decd is the last 
will and testament of the said Jacob.  By the Court ordered that the last will 
and testament of Jacob Eason decd be admitted to probate and the same being 
proved by Wm. R. Skinner & Joseph Brinn the subscribing witnesses should and 
ordered to be recorded and Henry Skinner the executor appeared and was 
qualified according to law &c.
