Vs. WILLIAM NAILING and JOHN SMITH Original Bill It appearing to the satisfaction of the Court that one of the defendants, JOHN SMITH, who is entitled to a part of the tract of land, is not a resident of this State. It is therefore ordered by the court that publication be made for three successive weeks in the Raleigh Minerva, that unless the said defendant appear and file his answer to the bill of Complainant at the next term of this Court to be held for Chatham County on the 1nd Monday in March next, judgment will be taken pro confesso and heard ex parte.
