Benjamin Hill and Alexander McCulloch Gent. of the one part and James Ray of the other part whereas the sd. Henry McCulloh by a Certain wrighting (sic) of Letter of Attorney under his hand and Seal duly Executed bearing date the twelvth day of June 1747 Amongst other things therein Contained did Authorize and fully Impower the sd. Benjamin Hill and Alexander McCulloch on his behalf to bargain for Sell and Convey Such Tracts of his Land or parcels thereof as by them or Either of them Should be thought fit to be Sold & Conveyed NOW this Indenture witnesseth that for and in Consideration of the sum of twenty pounds Current Money of Virginia to them well and truly paid by the sd. James Ray before the Ensealing and Delivery hereof the receipt whereof is hereby Acknowledged he the sd. Henry McCulloh by them the sd. Benja. Hill and Alexander McCulloch his Attorneys hath granted Bargained Sold aliend Enfeoffed Conveyed and Confirmed unto the sd. James Ray his heirs and Assigns forever all that Tract or Parcel of Land Containing three Hundred and fifty Acres Situate on the South Side of Little River in the County of Granville in the Province afsd. begin. at a Hickory Standing on the river Banck and runs No. 45 Wt. 292 poles to three black Jacks then No. 45 Et. to a Hickory Opposite to Boggan’s beginning then down the river to the first Station it being part of a Tract of Land granted to the sd. Henry McCulloh by Patent bearing date the Third day of March 1745 will more fully Appear with all Trees woods waters profits Commodities Hereditaments and Appurtenances whatsoever to the sd. Land belonging or appertaining one Moiety of all Mines and Minerals reserved to the use of the sd. Henry McCulloh his Heirs or assigns and the reversion & reversions remainder and remainders rents & issues and Profits thereof and of every part thereof and all the right Title Interest Claim and Demand whatsoever of the sd. Henry McCulloh of in and to the sd. tract of Land and premises and every part thereof TO HAVE AND TO HOLD the sd. granted and bargained premises to him the sd. James Ray his heirs and assigns forever to his and their own proper use benefit and behoof Subject to the payment of all Quit rents due therein and all Covenants Mentioned in the sd. patent and the sd. Henry McCulloh by them the sd. Benjamin Hill and Alexander McCulloh his Attorneys so by these presents Covenant and Agree to and with the sd. James Ray his Heirs and Assigns the sd. Henry McCulloh shall and will warrant Secure and forever Defend the premises Hereby granted unto the sd. James Ray his Heirs and Assigns against the lawful claim or Demand of any person whatsoever IN WITNESS whereof the said Benja.
