The condition of the above obligation is such that whereas the above bounden Heymrick HOOKER hath sold to the said James S. SMITH a certain piece of land which he drew in right of his wife Worth? ORMOND, dec'd, the said Martha being the sister & heir at law of said Adam and in Law has to join in with said HOOKER in conveying the said Land when she may arive at the age of twenty one years the said James S. And whereas the said Silvester FORREST is honestly desirous to secure the payment of the said debt or debts, Now, therefore this Indenture Witness that for and in consideration of the promises with the further sum of one dollar to the said Edward R. COWARD the receipts whereof is hereby acknowledged in full. He the said Silvester FORREST has granted bargained and sold and by these presents doth grant bargain and sell unto the said Edward R. In Special trust and confidence Never the less that the said Silvester FORREST shall and will hold keep, use and apply the same to the use and intents following and no other, that is to say, That if the aforesaid debt or debts and every part there of together with the lawfull interest that may have arrived on then shall not be fully paid of and satisfied within Nineteen Months from the date. Then in that case it shall be lawfull and shall be the duty of the said Edward R. COWARD being thereunto required by the said William F. EDWARDS & others having first Advertised the same at the Court House in the Town of Snow Hill and three other public places in the said County for the space of Twenty days to proceed to sell the Lands and premises at public auction to the highest bidder for ready money and conveys the same by proper and sufficient ----- to the purchaser and out of the proceeds or moneys rising from the said sale, to return all the necessary expenses of this trust and then pay off and discharge the said debt & debts and interest, or such part there of as shall remain unpaid at the time of sale and the over ---- if any he shall truly and forthfully? Edward CARMON of the county of Greene and state of North Carolina am held and firmly bound unto the state of North Carolina in the sum of three hundred and fifty dollars to the true and faithful payment whereof I bind myself by my said attorney my heirs executors and administrators firmly by these presents sealed with my seal by my said attorney the 28th day of __ A.D. 1853. The condition of the above obligation is such that whereas the above bounded Micajah T. HART has this day received by payment into the hands of his said attorney Edward CARMON of Edward R.
