Bryan against Benjamin C. D. Eason by his attorney William Washington – Plea of Trespass to the damage of $1,000 – first trial was in 1840 in Greene Co – jurors were Henry W. Edwards, John Sugg, James Y. Williams, Hillory Taylor Jr, Benja Edwards, William B. Taylor, Lewis Lane, Josiah Sugg Sr, Jesse Hart, James Mooring, Merrett Ormond, Cullen Edwards Plf introduced a witness, one Silas Walston, who testified that he, the def, was a JP and handed him a note in favor of one Samuel Moore against the current plf with instructions to collect it as soon as he could – the witness was a constable and went to Eason's house 6 or 7 days later on Sunday evening and the next morning between daybreak and sunrise he went to Jones' house where he was putting on his clothes before he went to Edgecombe Co where he was working – Walston told Jones his business and told him he had to go to trial that day and he must go to Eason's house which was the nearest magistrate but Jones refused – he finally agreed to go to the gate and Eason came out and had the trial and said Jones owed $9 but Jones said it was only $7 – Jones said to prove it and Eason said he knew his handwriting and he owed the money – Jones said he could give security of one Amrafflen Beeman who lived about a mile away, or he could get the money from Mr. Webb about 3 miles away in Edgecombe Co, or Willie Barnes could go get the money – Barnes came back without the money and Eason and several others set off to Snow Hill with Jones and about a mile away they met John Beeman and Jones asked him to be security and Beeman asked for an additional person for security but this did not happen – they proceeded on to Snow Hill and stopped at the house of Miss May where Eason and Jones had business – while at Eason's house he invited them in for breakfast and drink and Jones refused – it appears that Eason also owed Samuel C. Moore money - $70.50 Willie Barnes testified he was present at the trail of the warrant in favor of Moore NOTE: It appears that Eason and Jones just did not like each other from comments among the papers Jeremiah Beeman stated he was the son of John Beeman and that he carried a letter from J. ?? L. ?? Eason to the def B. C. D Eason William Webb testified he lived 3 miles from Eason in Edgecombe Co and he would have been surety Elkanah Bailey testified he was at Eason's gate and said Eason said $9 and Jones said $7 Jury found for plf and def asked for new trial There is a note in the papers – Benjamin C. D.
