Greene County, NC - Edward Carmon vs Seth Moore, 1860 ~~~~~~~~~~ #8276 EDWARD CARMON vs SETH MOORE Greene County NC, June 1860 Wills of Ephram Moore and Jesse W. Moore annexed but will not be posted until early 2008 Court Equity Case – Edward Carmon adm vs Seth Moore, Elizabeth Moore, Robert Dixon and Rachel his wife, Ester Dixon, Benjamin Dixon, Penina Dixon, Seth Dixon, Sarah C. Dixon, Nancy Dixon, the last infants, Nancy Brinkly, unknown Parrott and his wife Zilpha Sometime in 1856 Jesse W. Moore of Greene Co. departed this life making his last Will and Testament which was proved Nov. Term 1856 in Greene Co – William Dixon was named executor but he refused and Edward Carman petition to be appointed – Carman has returned to the Court a list of the slaves and property, paid all debts, and he is now ready to settle the estate but the will is obscure in some of its provisions and he needs some assistance on the intent The legatee, Elizabeth Moore, is of feeble intellect and quite idiotic – Carmon understands that Ephraim Moore who was the father of said Jesse Moore, Elizabeth Moore, Seth Moore, Rachel Dixon, and Nancy Brinkly and grandfather of the other defs gave to all his children except Jesse and Elizabeth equal shares of his estate – to Elizabeth he gave nothing directly and to Jesse he gave slaves Cuff, Vicey, Willis, Caroline, Late and her children and Joseph which was double the equal share for the support of Elizabeth during her life – for further information refer to sd will – Carmon does not think what is included for Elizabeth in the will of Jesse Moore is enough to support her and the instructions are that she is not to reside with the brother Seth, which is unreasonable and Jesse had no right to so impose this stipulation – Carmon states that Seth Moore states the slave Jane is of no use to him and is a burden as she is an idiot and deformed and he refuses to accept her – Carmon further states that the sd slave, Jane, will have to be supported – the heirs of Jesse Moore say the clause emancipating the slaves is void because it contemplates them not remaining in the state and said slaves do not wish to leave the state – he feels the slaves should be divided among the heirs who were Seth Moore, Elizabeth Moore, Rachel wife of Robert Dixon, Nancy Brinkly and these are his brothers and sisters and Zelphia wife of a Parrott whose first name is not known is a grandchild – Esther, Benjamin, Penina, Seth, Sarah and Nancy Dixon are under age and the children of sd Robert Dixon and Sally his late wife who was the sister of Jesse – Carman states he thinks the Parrotts to be living in Fla. Answer of Seth Moore and Elizabeth Moore by her next best friend, Seth Moore – they state that Jesse Moore died in 1856 – Elizabeth Moore is deaf and dumb – they need more support for Elizabeth NOTE: Carman is also spelled Carmon in the case. Zilpha Moore md William John Parrott moved first to Darlington Co, SC and then to Leon and Gadsden Counties, Fla where they died.
