TO THE USE OF HOLLIDAY vs EASTWOOD 1827, Greene County NC Supreme Court Case found at the NC Archives, Raleigh, NC Abstracted by Martha Mewborn Marble Gov. to the use of the Executors of Thomas Holliday vs James Eastwood Greene County May Term 1825 At the Nov. 1822 Greene Co Court of Pleas and Quarter Sessions came the Gov. – to the use of the Executor of Thomas Holliday dec by John Hawks and George Well their attorneys – James Eastwood, William Hooker, Daniel Scarborough and Thomas Hooker were the Adms of Hymrick Hooker, dec – William Holliday and Sylvester Brown were the Execs of Thomas Holliday dec in a plea of debt in the sum of $5,000 plus $500 in damages On the jury were – William Speight, Shute ?? Dixon, Ethelridge Pridgon, Francis Brown, John Pope, Arthur Speight, James W. Hooker, Redding Minshew, Stephen Rogers, William Stanley, John Grimsley and John Turnage 4 March 1826 – Sheriff to summon to court Henry Miller, Nathan Hooker, Adms of William Hooker dec and Thomas Hooker Adm of Hymrick Hooker, dec Eastwood was the former Sheriff of Greene Co and under him the Exec of Thomas Holliday recovered 3 judgments against Isaac Brand and others amounting to $300 – from Feb and May Courts 1820 – the sd Eastwood on 6 April 1820 levied the same on several Negroes and a tract of land of Isaac Brand but they did not sell for lack of bidders – the plff produced a WIT , Isaac Brand who swore that on 27 Feb. 1821 Eastwood made a sale of the Negroes for $1,500 and on the same day sold the land for $1,500 – it was determined the amt raised exceeded the demands the Sheriff had The question appears to be if the Sheriff acted appropriately with the excess money The jury found for the defs and a new trail was ordered File at: http://files.usgwarchives.net/nc/greene/court/eastwood867nwl.txt This file has been created by a form at http://www.genrecords.net/ncfiles/ File size: 2.4 Kb
