Greene County, NC - Lassiter vs Harper, 1849 ~~~~~~~~~~~~~~~~~~ #4684 LASSITER VS HARPER Greene County 1849 Martha A. Lassiter vs Charles H. Harper Greene County Spring Term 1849 - her attorneys were Wm. B. Rodman and F. B. Satterthwaite - 22 Oct 1847 - Redding Rasberry made oath that Uzzell Lassiter and Martha Ann Lassiter lived together in Greene Co as man and wife from at least 10 Jan 1834 and up 28 June ?? 1847 and she was his lawful wife Martha stated that on 6 March 1847, Charles H. Harper, Adm of C. H. Harper dec to the use of Henry H. Harper set out a warrant against Martha Ann Lassister and her husband Uzzell Lassiter and on the 2nd August 1847 obtained a judgement on a note made by Uzzell Lassiter and Martha then his wife - an execution was on her land, a tract adj Josiah Murphrey - 100 acres - another tract of 100 acres was adj John Dail - another tract of 20 acres was adj to Blaney Turnage - Harper obtained a judgement in June 1848 - on 1 March 1847 Thomas Dail B. L. (sic) use of R. M. Harper sued Martha and Uzzell Lassiter and received a judgement NOTE: Dates are not clear Uzzell of seized of said lands in right of his wife - when the judgements had been returned said Uzzell had died and Martha thought the judgements were void - Martha stated she was told she did not have to appear at Court - she had no marriage settlement with her husband nor did she have any separate estate. There were additional defs in an earlier case and said defs were Martha and Uzzell Lassiter, Robert and Uzzell Lassister Jr - Charles Harper Adm to C. H. Harper said Martha and Uzzell owed him $94.50 due by note and damages of $50. NOTE: Not sure if there was an earlier Supreme Court case but will check later The 200 acres was known as the Brand land Martha A. Lassiter, R. Lassiter, S. Lassiter and E. Carmon to be bound to H. H. Harper for $200 - signed Martha Lassiter, Robert Lassiter, Edward Carmon, Stephen Lassiter' Martha stated she knew nothing about the trial or the judgement - she can't pay and does not think she is liable. Harper stated that Martha had no objection as she knew her husband owed the money A note stated that James Exum lived in Miss but the County was not readable although I am inclined to think it was a misspelling of Oktibbeha. ___________________________________________________________________ Copyright.
