#490 – EASON vs WESTBROOK

Sept 1814 – John Eason and Dorcas his wife vs Henry Westbrook and Matthew 
Garland – plea of trespass – the Easons are asking for damages of 500 pds

In Jan 1811 the sd John and Dorcas in right of sd Dorcas were owners in fee 
simple subject to an estate for the life of one Rachel Speight of a tract of 
land in Greene Co of 57 acres of equal value to wit of the value of 300 pds – 
this being part of a tract which descended to the sd Dorcas as one of the 
heirs of Samuel Speight and the land was allotted to sd Dorcas to hold in 
severalty – a writ was issued by the Court on 12 Nov. 1812 commanding the 
Sheriff to expose to sale at the Courthouse 400 acres of the land the property 
of Rachel Speight to satisfy certain sums of money – the lands came into the 
possession of Westbrook who was the Sheriff yet he continued to defraud the sd 
John and Dorcas and caused the sd land to sell for life – the 57 acres was 
part of the 400 acres – the sd Westbrook conspired with the sd Matthew Garland 
and on 10 Dec the land was sold without notification to the sd John and 
Dorcas – the price was a very small sum and was sold to sd Garland

The jury said Garland was not guilty but Westbrook was and he was assessed 
$142.14 for damages

The present Sheriff said the judge did not instruct the jury properly and 
appealed to the Supreme Court.
