C. Archives by Frederick Lee Edwards. Copy in my possession NOTE: William Ormond and Charles Joiner were brothers-in-law. Charles married Eliza Coward, daughter of Cullen and Sidney Phillips Coward. Cordelia Coward, Eliza's sister was one of the wives of William Ormond State of North Carolina In the Superior Court of Law for the County of Greene on the Second Monday after the fourth Monday in September 1834 Be it remembered that heretofore to wit at Spring Term 1834 held on the second Monday after the fourth Monday in March 1834, the Honorable JOHN R. DONELL presiding the following Gentlemen were drawn and sworn as Grand Jurors for the Term Viz. AUTHUR SPEIGHT, foreman, ALLIGOOD OLDS, WASHINGTON DIXON, DEMPSEY WOOD, JOHN SUGG, WILEY JONES, BENNET M. MURPHEY, WYATT MOYE, JOHN PATRICK, SMITH PRIDGEN, BLANNA TURNAGE, HENRY BEST, JR, STEPHEN RASBERRY, RICHARD SMITH, HENRY MILLER, KINCHIN WARD, WILEY RASBERRY, and EDWARD COWARD, came the State by CHARLES JOINER as presecutor, STEPHEN MILLER Esqr Solicitor and brought here unto Court his bill of Indictment against WILLIAM ORMIND in the following words viz State of North Carolina Superior Court of Same Spring Term Greene County 1834 The Jurors for the State upon their oaths present that WILLIAM ORMOND late of the County of Greene on the first day of January one thousand eight hundred and thirty four with force and arms at & in the County aforesaid unlawfully did bite off the ear of one CHARLES JOINER at and in the County aforesaid with intent him the said CHARLES JOINER, to main and disfigure contrary to the act of the General Assembly in such cases made and provided to his great damage and to the evil example of all other in like case offending and against the peace and dignity of the state and the Jurors aforesaid upon their oaths aforesaid do further present that WILLIAM ORMOND afterwards to wit on the day and year aforesaid at and in the county aforesaid with force and arms and assult did make upon one CHARLES JOINER in the peace of God and the dignity of the State then and there being and him the said CHARLES JOINER then and there did beat wound & ill break and other wrongs then and there did to said CHARLES JOINER to him great damage and against the peace and dignity of the State. You are hereby commanded to take the body of WILLIAM ORMOND, if to be found in your county and him safely keep so that you have him before the Honorable the Judge of our Superior Court of Law at the court held of the County of Greene at the courthouse in Snow Hill on the second Monday after the fourth Monday of September next, then and there to answer the State on a bill of indictment found true by the Grand Jury for an assult & battery at Spring Term 1834. Herein fail not, and have you then & there this writ. Witness WM. HART, Clk of our said Court at Office the Second Monday after the fourth Monday of March and in the 59 year of our Independence AD 1834 Signed the 17th day of May AD 1834 WM HART CGSC And the Sheriff of Greene County viz JOHN W. TAYLOR, Esq now here returns, executed and recognisace returned herewith. SIGNED JOHN W. TAYLOR, Shff Therefore the said defendant for fall term 1834 to defend the wrong and injury by GEORGE W. MORDICEI Esqr attorney, the Honorable WILLIAM NORWOOD presiding and pleads not guilty and of this he puts himself upon the county and the said plantiff, doth the like, therefore let a jury come before the court aforesaid Viz and who neither to recognize because as will as the same day is given the said parties -At which day came the said parties by their attornies aforesaid and a Jury of good and lawful men having been drawn by the Court of pleas and quarter Sessions and summoned by the Sheriff according to the form of an act of assembly which Cases provided who appearing to wit, TITUS CARR, THOMAS DAIL, JAMES GARLAND, ELISHA BORGERRON, WILLIAM TURNAGE, REDDING RUFF, ISHAM DIXON, ALLEN A. SMITH, OWEN W. JONES, ASA DANIEL, WILLIAM DARDEN, JONATHAN T. EASON, and being duly elected tried & sworn to say the truth of the matters in fact between the said parties do upon their oaths aforesaid say, the find the defendant guilty generally. A motion in arrest of Judgement the first county of the Indictment for a mayhem, whereupon Judgement is arrested on the said first county, and Judgment is pronounced upon the second count for an assult and battery. That the defendant pay a fine of five dollars, be imprisoned sixty days and stand committed till find and cost be paid from which Judgement the defendant prays an appeal to the Superior Court which is granted by this entering into bond in the sum of fifty dollars with CHARLES EDWARDS and JAMES HARPER securities, which said bond is hereunto annexed.
