Greene County, NC - Court - Ormond vs Faircloth, 1804 428 – ORMOND vs FAIRCLOTH NC Supreme Court found at the NC Archives, Raleigh, NC New Bern District – Jan Term 1804 – Greene Co Regarding the ownership of a Negro – it was the property of William Faircloth, dec at his death and came into the hands of his administrator – Benjamin Sheppard obtained two judgments against the adm in the Court of Lenoir – then writs in Glasgow County – Negro allotted to the def Subsequent term in Jan 1793 the sheriff of Glasgow sold the Negro at a private sale to John Grimsley for the full worth – Grimsley had the Negro for about 4 years and devised him to his daughter the wife of the plf – the plf had him in his possession until May 1802 when the def took him – jury instructed that the sale was not valid because it was done at a private Sheriff's sale - plf moved for a new trail because of the instructions to the jury ______________________________________________________________________ Copyright.
