Greene County, NC - Albritton vs Sutton, 1847 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ NC Supreme Court Case #4646 - ALBRITTON vs SUTTON - Greene County - found at the NC Archives. Fall Term 1847 - Petition of James Albritton, Adm of Benjamin D. Harper, dec - Hugh P. Harper late of Greene County departed this life _____ with a Will - Albritton was appointed Adm of Will and set about to administer it. He assented to several legacies including for the son Benjamin D. Harper Following is a part of the Will of Hugh P. Harper. William Sutton was appoint Guardian to sd Benjamin D. Harper and received all the estate of sd Benjamin consisting of land, Negroes, stock, Bonds and cash which he has annually rented out at a large profit. Sometime in the latter part of the year 1846, the said Benjamin D. Harper died before arriving at the age of 21 and the said Albritton was appointed Adm to the estate. Albritton claims to have be entitled to the rents and profits of the estate in the hand of his (Benjamin) guardian, William Sutton, and request said Sutton to turn over the rents and profits of estate. Sutton refuses to do so saying the Petitioner is not entitled to said funds. Petitioner wishes the Court to question Sutton Answer of Sutton - Petitioner has not shown he is entitled to the estate. The Will of Hugh P. Harper left to his siblings William H. Harper, Rosey Pope, Rachel Sutton, Eliza Hartsfield and Matilda Harper.
