Greene County, NC - Benjamin W. Taylor Exr vs Major Smith & wife ~~~~~~~~~~~~~~~~~~ NC SUPREME COURT CASE #7329 – BENJAMIN W. TAYLOR EXR vs MAJOR SMITH & WIFE – Greene County – Nov 1858 – Found at the NC Archives, Raleigh, NC. Submitted by Martha Mewborn Marble Benjamin W. Taylor, exec of Mary Sauls, dec against Major Smith and wife Winifred, Absalom Taylor and wife Absaly, Henry Taylor, the children of Joshua Taylor and John Gray ?? and wife Celia, Grady & Janette, Rebecca, Mary & Patsy Uzzell, the five daughters of Joshua Uzzell and Mary Ann Taylor daughter of Henry Taylor, John Taylor and Henry Taylor. NOTE: This is exactly as written and is not clear and there is nothing to clear all of it up later in the case except it appears none of the children of Joshua Taylor are listed. Mary Sauls departed the life in the year 1855 leaving a Will proven May Term 1855 – the testator bequeathed and devised as follows: NOTE: part of the Will follows – see the entire Will in a previous Newsletter Your Orator administered the estate – he stated the dec Mary Sauls was indebted to John Taylor in a large amount of about $200 – John Taylor has brought a judgement against your Orator and your Orator has been compelled to take a large part of the money left by sd Sauls to satisfy the judgement therefore there is not enough money to satisfy the intent of the Will – the legatees with specific chattle do not want their inheritance sold to help pay the debts – your Orator is uncertain how to proceed and needs advice of the Court. The names of the children of Joshua Taylor are unknown as Joshua lives out of State, probably in Georgia. Janette, Rebecca, Mary and Patsy Uzzell are minors under the age of 21 years and with guardian.
