Spaight – New Bern Superior Court – July Term 1804 March Term 1792 – plf recovered against Thos Wade and Bolden ?? Wade exec of Thos Wade the elder, 2000 pds for a debt of 8 pds but the plea of fully administration was found for def – def were Will Wade, Judith Wade, Polly Wade, Sally Wade, Thomas Vining and Polly his wife, Joshua Prout and Sarah his wife – heirs – Thomas Wade the elder dec with a large estate sufficient to pay the debt and costs which was devised by him to Thomas Wade the younger, Holden Wade, Polly Vining the wife of Thomas Vining, and Sarah the wife of Joshua Prout – Thomas the Younger was dec and the estate devised to him has descended to his heirs the said Will and Judith – the said Holden Wade was also dec and the estate devised to him had descended upon his heirs the said Polly and Sally – praying execution of the debt and cost to them the devised and descendents William, Judith, Sally and Polly appeared by their guardian and a judgment was entered against them as well as Thomas Vining and wife by default but upon condition the said William, Judith, Polly and Sally not be liable for any estate which had come or will come to them other than what was devised by Thomas Wade the elder, Thomas Wade the younger or Holden Wade Joshua Prout appeared for himself and wife as devisee of Thomas Wade the elder and pleaded nothing – he said the lands he was in possession of was not mentioned in the devise to Sarah his wife and were never bound by any judgment against Thomas Wade the elder Judgment went against the heirs ______________________________________________________________________ Copyright.
