Supreme Court Original Cases 1800-1909,Case #7431, N.C. Archives Benjamin S. Edwards and James G. Edwards - 1842 Deed, Greene County, N.C. This indenture made and entered into this 30 day of December in the year of our Lord one thousand eight hundred and forty two by and between Benjamin S. Edwards of the County of Green and State of N.C. of the one part and James G. Edwards of the same County and State of the other part witnefseth that the said Benjamin S. Edwards for and in consideration of the sum of Two hundred and fifty dollars to him in hand paid by the said James G. Edwards at and before the sealing and delivering of these presents the receipt whereof is hereby acknowledged and from the payment thereof the said Benjamin S. Edwards doth hereby acquit release and discharge the said James G. Edwards....hath granted... unto the said James G. Edwards...all the right title and interest which he the said Benjamin S. Edwards hath in and to a certain mill & mill seat situated & lying in the County of Greene & State of N.C. on Fort Run - known as the Fort Run Mill - which said mill & mill seat was given by Theophilus Edwards the father of Benjamin S. & James G. Edwards to said Benjamin S. & James G. Edwards as tenants in common as will appear on reference to the deed from the said Theophilus Edwards to the said Benjamin S. & James G. Edwards bearing the date the day of 18 together with all the land which may be covered by the water of the Mill pond up to high water mark To have & to hold all the right title and interest of the said Benj. S. Edwards in & to the said Mill and Mill seat together with all and singular there privileges...to the said James G. Edwards...& it is agreed by and between the said parties as follows to wit that the said James G. Edwards...shall at no time hereafter be liable any action suit claim or demand for damages which may arise from the overflowing of any part of the lands of the said Benj. S. Edwards which are not contained in this indenture which may be occasioned by the erection or raising of the Mill dam of said Mill & the said James G Edwards...agree to and with the said Benj S Edwards...that he the said Benj S. Edwards his Family shall and may have the priviledge of grinding sowing and picking cotton at the aforesaid Fort Run Mill toll free for his Family use and further that if he the said Benj. S. Edwards shall at any time hereafter settle either one of his sons at the Bridge place belonging to the said Benjamin that with one of his sons as may be there settled shall have & enjoy the privilege of sowing grinding & picking cotton for himself & his family at the ...Fort Run mill free from toll, but this privilege is intended to extend no further than to such son during his life & for his own family use....that he the said Benj S Edwards (is) seized of a good sure & indefensible estate in fee simple...& that he will at any & all times hereafter where thereunto required by the said James G Edwards...make do and execute all such other & further acts deeds or conveyances for the better and more perfect assurance of the premises to the said James G Edwards his heirs and afsigns as he or they or theirs may or require In testimoney where of the said parties have hereunto set their hands and affixed their seals the day and year first above written Signed sealed & delivered in presence of John T.
