Wayne County, NC - John Edmondson to Vicey Parks, 1832 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Whereas a marriage is intended to be had shortly solemnized by and between JOHN EDMONDSON (sic) of Greene County and VICEY PARKS of Wayne County and it hath been agreed between them that the said marriage shall make no change in the present rights of each to his or her own property and estate but that each one shall keep the property owned by each as though no such marriage had taken place. Now therefore in execution of said agreement and in anticipation of said marriage this indent-ture made between the said VICEY PARKS of the one part JOHN EDMONDSON of the second part and JOHN EXUM of Wayne County of the third part Witnesseth that the said parties of the first and second part in consideration of the premises and in the further consideration of the sum of one dollar in hand paid have bargained sold and conveyed unto the said JOHN EXUM the following property to wit and all the household and kitchen furniture now owned by VICEY PARKS which is more specially described in a schedule made out this day and signed by the said VICEY PARKS and JOHN EDMONDSON attached to this deed and made a part thereof. Also the following negro slaves to wit: Peg and her two children Will and Martha Jane, Barbary and her children Polly and Esther, Bithy and her child Bob, Amy, Ephraim, Harry, Hampton, Peter, Patience and Lewis and the increase of the said slaves. To have and to hold the aforesaid negro slaves and their increase and the other property aforesaid upon the following trust to wit. If the marriage herein before spoken of shall not be solemnized the said EXUM shall and may upon demand of him made at any time before the said marriage reconvey to the said VICEY PARKS all his title and interest derived under this deed, and if the said marriage shall be solemnized immediately thereupon the said EXUM shall hold the said negroes and their increase and other property for and to the sole and separate use of the said VICEY free from all control of her husband in any manner or form during the coverture and upon the further trust that the said negroes and other property or any part thereof may at any time during the coverture be given away or sold by the said VICEY free from the control of her husband and the trustee shall seal and deliver any conveyance of the same which the said VICEY shall by writing under seal authorize and direct and if the said VICEY does not give in writing or sell the said slaves and their increase and other property during her life then although she be covert of the said EDMONDSON at the time she doth make the same yet by a will or writing in the nature thereof she may dispose of the said negroes and other property as she may choose provided only that the said will or writing in the nature of a will be published and attested after the form and manner that is required by law for making valid last wills and testa-ments of such property and estates. And further if the said VICEY die covert of the said EDMONDSON before she hath sold, given away or willed away the said negroes and other property then the same shall be held in trust for such person or persons as would be her next of kin - not counting her husband and upon proper demand made the Trustee aforesaid shall convey to them accord-ingly. And this indenture further witnesseth that the said party of the first part being owner of sundry property not included in this deed which hath valued on this day at the sum of nine hundred and ninety four dollars and eighty seven cents and the said property being _____ up to the party of the second part but upon the agreement that he is to pay for it at valuation, the said party of the second part hereby binds and obliges himself and his heirs and executors and that he will pay or cause to be paid unto the said JOHN EXUM, Trustee as afore-said the sum of nine hundred ninety four dollars and eighty seven cents afore- said either upon the death of the party of the first part or of the second part whichever shall first happen which said sum of money shall be held by the said trustee upon precisely the same terms and trusts that are herein declared concerning the negroes aforesaid. And before the event shall happen when this bond shall fall due the obligation itself shall be held upon the same trust and terms in all respects. And it is further agreed by the party of the first part and party of the second part and with the party of the third part that he shall be made in no way responsible for the hires and profits of the aforesaid property or for the loss thereof but the same is to remain under the control of the party of the first part during the coverture aforesaid and it is further agreed by the party of the first part to and with the party of the second part that if she shall survive the said party of the second part she will assert no claim for dower or for any portion or provision out of the estate of the party of the second part but she doth now release the same for herself and her heirs and will seal and deliver at all times any other deed or deeds which may be required to bar her self and her heirs from all claim or demand upon the estate of the said party of the second part for dower or provision out of personal goods in any form. And it is further agreed by all the parties to this deed that the present existing debts of VICEY PARKS and all debts contracted by or for her before this marriage with the said JOHN EDMONDSON shall be paid by her out of the property con-veyed herein and the said debts shall be a charge upon said property in the hand of the Trustee aforesaid if any such debts there be.
