Devised [No Date], Probated April 7, 1873 In the Name of God Amen. I Benj. Canidy of the County of Greene, state of North Carolina, being of sound mind and memory but considering the uncertainty of my earthly existence, do make and declare this my last will and testament in manner and form following: That is to say. First I wish my executor herein after named shall provide for my body a decent burial suitable to the wishes of my family and friends and pay all funeral expenses, together with my just debts howsoever and to whomsoever owing out of the first monies that shall come into his hands as part or parcel of my estate. Item 1st I give and bequeath to my beloved wife Sarah Canidy in lieu of the right of dower in my lands, the following tract or parcel of land bounded as follows: beginning at the road at the mouth of a ditch between my home and John Creech's and runs with the various courses of said ditch to a branch, thereup the said branch to the public road, then with the said road to the beginning, to have and to hold during her natural life, and no longer with the knowledge of taking such timber and fire wood on one part of my land. I further give and bequeath to my beloved wife Sarah Canidy three hundred pounds of meat, ten barrels of corn, one barrel of flour, twelve pounds of coffee, fifteen pounds of sugar, five gallons molasses, all the chickens on hands, one sow and pigs, or sow with pig, one cow and calf or cow with calf, two beds and furniture one of them at James Taylor's, one dining table also at James Taylor's. I also lend her during her natural life all the cooking utensils on hand, all the plates, knives, an forks, cups and saucers, and all my sitting chairs after her death to go to my heirs. Item 2nd I give to my daughter Susan Jones thirty acres of land, which is to advance her equal to my daughter Eliza, to have and to hold to her and heirs, absolutely forever. Item 3rd It is my will and desire that the balance of my land be equally divided between my daughters Eliza Creech and Susan Jones each to share and share alike, to have and to hold to them and their heirs forever. Item 4th I give to my daughter Susan Jones seventy five dollars to be paid to her by my executor within two years after the probate of this will. Item 5th I give to my daughter Eliza Creech seventy five dollars to be paid to her by my executor within two years after the probate of this will. Item 6th It is my will and desire that the residue of my property be sold by my executor and the money equally divided among all my lawful heirs or children to share and share alike. Item 7th Lastly, I constitute and appoint my son-in-law, John Creech my lawful executor to all intents and purposes is, to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof, hereby revoking all former wills and testaments by me made heretofore. Granger State of North Carolina - Greene County In the Probate Court A paper purporting to be the last will and testament of Benjamin Canady, dec. is exhibited before me the undersigned, Judge of Probate for said County by John W. Creech the executor herein named, and the due execution thereof by said Benj. Canady by the oath and examination of J. L. Jackson and J. W. Granger the subscribing witnesses thereto, who being duly sworn doth depose and say, and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Benj. Canady in the presence of this deponent, subscribed his name at the end of said paper writing, which is now shown as aforesaid and which is now shown as aforesaid and which bears the date of the __ day of ___ 187_. And the deponent further saith, that the said Benjamin Canady the testator aforesaid declare the said paper writing so subscribed by him, and exhibited, to be his last Will and Testament, and this deponent did thereabove subscribe his name at the end of said Will as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said Will as aforesaid, and at the time of the deponents subscribing his name as an attesting witness thereto, as aforesaid Benj. Canady was of sound mind and memory of full age to execute a Will and was not under any restraint to the knowledge information or belief of this deponent; And further this deponent say not. J. L.
