C. T. In the name of God amen: I, THOMAS Holliday, of said County and State, being now of sound and disposing mind and memory, but mindful of the close of my life at some day and desiring to dispose of my estate, by Will and testament, so hereby make the following my last Will and testament thereby revoking all others by me heretofore made. Imprimis: I wish my just debts, and funeral expenses paid out of any money on hand at my death. Item I. To my nephew JOHN HOLLIDAY, the son of my brother JOHN HOLLIDAY, of Aberdeen, Mississippi, I give my double barrell shotgun. Item 2. To my niece, MARY ANN HOLLIDAY, daughter of my said brother JOHN, I give the sum of three thousand dollars, in case, in currency. Item 3. I have secretly agreed with my nephew BENJAMIN P. HOLLIDAY son of my said brother JOHN, to enter into a retail mercantile business in the town of Okolona, Chickasaw County, Mississippi, in partnership with said BENJAMIN; and to that end have placed under his control, in cotton and in coin, about four thousand dollars, part of which is but to him to help make up his part of the capitol of the concern. To the same end I have also purchased from Murdock & Parchman in said town of Okolona a lot of ground on which I have caused to be built a store house and fixtures, which house & lot I value at fifteen hundred dollars in currency. I hereby give and devise to my said nephew BENJAMIN in fee simple the said store house & lot at said valuation of fifteen hundred dollars; and out of said means placed under his control for said mercantile retail business I bequeathe to him enough more to make up to him three thousand dollars in currency, including the store house and lot at said valuation, so as to make him equal in benefit under this will to his said sister MARY ANNE. Item 4. All the rest and residue of the estate of which I may die seized and possessed, or which may be due to me, and of whatever nature it may be, in possession or in action, and in law or Equity, I hereby devise and bequeath in fee simple to my said brother JOHN HOLLIDAY of Aberdeen and to his heirs forever. (which it shall be optional with himself to comply with, and is not coupled with this devise and bequest as a condition thereof), viz: - that at such time and in such manner as he may deem best and most suitable, he shall so dispose of the residuary and estate here devised and bequeathed to him with all of his children of his present marriage shall receive equal benefit from my estate ultimately, charging therein to MARY ANNE and BENJAMIN the aforesaid provisions made for them therein in and by Items two and three. His children are all alike beloved by me, and I would like for them at the proper time to derive equal advantage from my entire estate. This however is left optional with himself, as above expressed. I trust along to his impartial affection and justice toward his said children, and his respect for my private wishes. Item 5. I hereby appoint my said brother JOHN HOLLIDAY sole executor of this my last Will and testament, and I direct that he be allowed to qualify as such without giving Security on his bond. In testimony of the foregoing I here to set my hand and affix my seal this twenty seventh day of October AD eighteen hundred and sixty six. Thos.
