Greene County, NC - Will of Eli Jones, 1865 ~~~~~~~~~~~~~~~~~~~~~~~~~~~ I ELI JONES of the County of Greene and State of North Carolina, hereby of sound mind and memory, but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say: FIRST: That my executor (herein after named) shall provide for my body a decent burial suitable to the wishes of my relatives and friends and pay all funeral expenses together with my just debts however and to whomever owing and of the money that may first come into her hands as a part and parcel of my estate. SECOND: I give and devise to my beloved wife ELIZABETH JONES all my lands that I am in possession of and all my personal property of every description for her to have the use of, for and during her natural life. THIRD: I give and devise to my oldest son REDDING B. JONES fifty acres of land more or less bounded as follows: Viz Beginning at a maple in Sowell Branch and running with a new marked line to the south line of the old patent line a stake: Thence up the patent line to a light wood stump near the head of Sowell Branch: Thence down the said branch to the beginning, except the life estate of my wife devised in a former item of this my will, to have and to hold to him, his heirs and assigns in fee simple forever. I give him one bed, bedstead and furniture to him, his heirs and assigns forever. FOURTH: I give and devise to my younger son GABRIEL P. JONES fifty acres of land more or less bounded as follows: Viz: Beginning at a maple in Sowell Branch and running with a new marked line to the south line of the old patent line, a stake: Thence down old patent line to a pine, the lower corner: Thence with the second line of the patent to Sowell Branch to a maple or red oak: Thence up the said branch to the beginning. Also twenty-two acres of land whereas the said GABRIEL P. JONES now lives. Also one bed, bedstead and furniture and kitchen furniture which he has now in possession, except the life estate of my wife, devised in a former item of this my will, to have and to hold to him, his heirs and assigns forever. FIFTH: I give and devise unto my daughter NANCY BRAXTON, wife of JOHN BRAXTON, one bed, bedstead and furniture, kitchen furniture, one cow which she has possession to her heirs and assigns forever. Also I lend her a tract or parcel of land containing twenty-five acres bounded as follows, viz: Beginning at the fifth corner of lot no. 2 in the division of RICHARD HILL, deceased, land and runs S. 27 1/2 E. to a stake: Thence to WILEY HARRISON'S line to ELI JONES corner: Thence with said JONES line to the beginning for her to have the use of during her natural life. After the death of said NANCY BRAXTON, I give said twenty-five acres of land to my grand daughter SMITHY BRAXTON to her heirs and assigns forever. SIXTH: I give and devise to my daughter MARTHA ANN SUGG wife of PATRICK SUGG one bed, bedstead and furniture, one cow and one calf, and kitchen furniture, which she has possession, to her heirs and assigns forever. Also I lend her a track or parcel of land containing twenty- five acres bounded as follows: viz: Beginning at a stake NANCY BRAXTON second corner: Thence down South 27 1/2 E. to a stake or tree. Thence to WILEY HARRISON'S line: Thence N. 27 ½ West: Thence with NANCY BRAXTON'S line to the beginning for her to have the use of during her natural life. After the death of the said MARTHA ANN SUGG, I give said twenty- five acres of land to my grand son ELI SUGG to him, his heirs and assigns forever. SEVENTH: I give and devise unto my daughter SMITHY JONES, one tract of land containing sixty-nine acres be the same more or less bounded as follows: viz: Beginning at MARTHA ANN SUGG'S corner and runs S. 27 1/2 E. to the lower corner of lot no. 2 in the division of the land of RICHARD HILL,deceased, to a stake: Thence N. 66 E. 50 poles to a stake: Thence North 27 1/2 W. with my line and WILEY HARRISON'S to MARTHA ANN SUGG'S corner: Thence to the beginning. Also one bed, bedstead and furniture to her heirs and assigns forever. ITEM EIGHTH: After the death of my wife, ELIZABETH JONES, I want all the residue of my estate to be equally divided between my daughter SMITHY JONES and my grand daughter SMITHY BRAXTON. ITEM NINE: I do hereby constitute and appoint my wife, ELIZABETH JONES, my lawful executrix to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof, here revoking and declaring utterly void all other wills and testaments to (by) me heretofore made.
