Greene County, NC - Will of Richard E. Jones, 1901 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ North Carolina Greene County I RICHARD E. JONES of the County of Greene, State of North Carolina do make and publish my last will and testament in manner and form follow-ing, to wit: FIRST It is my will and desire that my burial be ordered and conducted in the manner suitable to the wishes of my relatives and friends, and that the service for such occasions used by the church which I belong be read at my funeral, which I desire to be conducted by the minister in charge of the congregation in which my membership is held. ITEM 2 I have heretofore made sundry gifts to my following named child-ren to wit, EVELINE H. wife of L.E. PRIDGEN, MARY V. wife of WILLIAM M. FIELDS, THOMAS F. JONES, GEORGE W. JONES and LELA C. wife of JOHN HOOTEN, and they are omitted from the provisions of this my will. ITEM 3 All of the land now owned by me consisting of two tracts situate in said County of Greene and described in this item of my will, and all other real estate which I may own at the time of my death. I give and devise to MARY CATHERINE, wife of my son GEORGE W. JONES, and to their child-ren in the manner following, to wit. To the said MARY CATHERINE JONES for and during the term of her life or (if she survives her said husband) her widowhood. And at and from her (the said MARY CATHERINE) decease or the determination of her widowhood. I devise the said real estate, including the two tracts aforesaid and all other real estate that I may own at my death as aforementioned, to the children of the said MARY CATHERINE JONES, born or to be born during her present marriage, to have and to hold to said children in equal shares, and to their heirs forever. But if any of said children shall die leaving issue previous to the time of my death then it is my will and desire that such issue shall represent his or her ances-tor (being such decedent child) and take the share which would have fallen to such ancestor, if the same were living. The said two tracts of land are described as follows. To wit: (Gives description of land, mentions Jones corner, Hill line, Gatlin Pate's line and 1/4 acre for grave yard on premises where he lived. Containing 94 and 1/2 acres. Second tract is one acre that he bought from THOMAS WOOTEN.) ITEM 4 It is my will and desire and I hereby direct that as soon as may con-veniently be done after my decease, all my crops, ____ farming tools, carts, buggies, household and kitchen furniture and all other goods chattels and personal effects which I may leave at my death, be sold by the executrix of this my will, by either private or public sale as she may think best, and that out of the money arising therefrom and any other moneys in her hands as executrix she pay for my funeral expenses and whatever I may owe EXUM & COMPANY, and WILLIAM W. FIELDS and the _____ all others my just debts out of the said funds. ITEM 5 The residue of said money after the discharge of said debts and the payment of the due and proper charges of administration on my estate I lend to the said MARY CATHERINE JONES for and during her life or (in the event of her survival of her said husband) her widowhood, and she is to have the same as aforesaid without being chargeable with any interest thereon. And from and after the determination of her life or widowhood, I give and bequeath the said moneys to her said children, born or to be born of her present marriage to them absolutely, share and share alike, and to the issue of such of them as shall have died leaving issue before the time of the taking effect of the bequest to them. Lastly I hereby constitute and appoint my beloved daughter in law the said MARY CATHERINE JONES my lawful executrix to all intents and purposes to execute this my last will and testament, according to the true intent and mean-ing of the same. I hereby revoking and declaring void all other wills and testa-ments by me heretofore made. In witness whereof I the said RICHARD E.
