Marble 58marble@suddenlink.net October 14, 2007, 11:11 pm Source: Nc Archives Written: 1852 WILL OF EPHRAIM MOORE Found in NC Supreme Court Case #8276, NC Archives, Raleigh, NC Transcribed by Martha Mewborn Marble In the name of God amen I Ephraim Moore of the County of Green and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare This my last Will and Testament in manner and form as follows, that is to say first that my Executor hereinafter named shall provide for my body a decent burial and pay all funeral expenses together with all my just debts to whomsoever owing out of the first money that may come into his hands as a parcel or part of my estate. Item 1st. I give unto my daughter Nancy Hartsfield (alias) Brinkley's children two dollars Item 2nd. I give unto my son Jesse W. Moore one negro named Cuff one negro woman named Vicey one negro named Willis one negro woman named Caroline and all of her children one negro boy named Joseph one Bed bedstead & furniture I wish him to take charge of my daughter Elizabeth Moore and have her bed bedstead & furniture and all of her own property. Also I wish him to appoint three persons to lay off one years provisions for my daughter Elizabeth Moore and her negroes which I have given to him and his heirs forever Item 3rd. I give unto my son Seth Moore one negro named Ring and all of the land which I am in possession of to him and his heirs forever Item 4th. I lend unto my daughter Sally Dixon one negro named Hannah during her life time then I give to her children but if she should depart this life without any lawful heirs I wish the property to return to my relations. I do appoint my son Seth Moore Trustee for Sally Dixon and her children. I wish him to take charge of all the property which I have lent her or may fall in her hands and manage it for their best advantage. Item 5th. I lend unto my daughter Rachel Hill one negro named Ben. Then I give it to her children but if they should depart this life without any lawful heirs I wish the property to return to my relations. Item 6th. I give unto my grand daughter Zilpha Parrott one negro named Mestin which her father has had in possession some time past. Item 7th. I wish my Executor to sell all of the balance of property on hand and divide it between Jesse W. Moore, Seth Moore, Elizabeth Moore, Sally Dixon and Rachel Hill the fourth part which fall to Sally Dixon I wish the Trustee to take charge of it for her. Item 8th. I hereby constitute and appoint my son Jesse W. Moore my lawful Executor to all interest and purposes to execute this my last Will and Testament according to the best interest and meaning of the law and do hereby declare every part and claim thereof and revoking and declaring utterly void all other Wills & testaments by me heretofore made. In witness whereof I the said Ephraim Moore do hereunto set my hand and seal this the 6th day of December 1851. Smith State of North Carolina Feby Term 1852, Greene Co Then was the foregoing paper writing purporting to be the last will and Testament of Ephraim Moore dec exhibited in open court and the executor thereof duly proven by the oath of George Kilpatrick one of the subscribing witnesses ???? & ordered to be recorded, at the same time Jesse W. Moore the within named Executor comes into court & renounces the executorship of said Will. Whereupon it was ordered that Jesse Vause be appointed Administrator to the will annexed & that he enter into Bond in the sum of ten Thousand dollars with Edward Carman and Thomas Wetherington sureties approved of by W. A. Darden, B. S. Edwards & Wm. Dixon Esq & ordered to be filed & the said Jesse W. Vause qualified according to laws, ordered that letters ???? accordingly. Attested Jos.
