Greene County, NC - Will of Sarah Smith, 1870

I  SARAH SMITH of the County of Greene & State of North Carolina 
being of sound mind and memory but considering the uncertainty of
my earthly existence do make and declare this my last will and 
Testament in manner & form following that is to say
FIRST  That my Executor hereinafter named shall provide for my body
a decent burial suitable to the wishes of my relatives & friends & pay
all expenses together with my Just debts howsoever & to whomsoever
out of the moneys that may first come into his hands as a part or 
parcel of my estate. 
ITEM  I give and devise to my daughter REBECCA SMITH all of my lands
that I now own it being one half of the tract where I now live to have 
and to hold to her the said REBECCA SMITH for & during the term of her 
natural life.
ITEM  I give & devise to my son WILLIAM I. SMITH all the land I now own
it being one half of the tract whereon I now live except the life 
estate of daughter REBECCA SMITH which I devise in a former item of 
this my will to have & to hold to him and his heirs in fee simple 
forever.
ITEM  I give & bequeath to my daughter REBECCA SMITH one feather bed
& furniture to have & to hold to her & her heirs in fee simple forever
ITEM  I give & devise to my daughter REBECCA SMITH one feather (blank)
& furniture to have & to hold to her the said REBECCA SMITH for & 
during the term of her natural life.
ITEM  I give & devise to my grand daughter SARAH SMITH & daughter of 
RUFUS SMITH one feather bed & furniture except the life estate of my 
daughter REBECCA SMITH in a former item of this my will to have & to 
hold to her & her heirs in fee simple forever.
ITEM  I give & bequeath to my daughter REBECCA SMITH Eight hundred
pounds of Pork or bacon & all the lard on hand, twenty five Barrels of
corn Eighteen Bushels of wheat & all the seed peas & farming imple-
ments & kitchen furniture & all the stock hogs except one sow which
I give to JAMES NEWSOM son of TALITHA NEWSOM, I also give my 
daughter REBECCA SMITH all the fodder on hand one cow & calf her
choice & all the poultry to have and to hold to her & her heirs in fee
simple forever.
ITEM  I devise to my daughter REBECCA SMITH one Brown horse mule
about three years old to have and to hold to the said REBECCA SMITH
for & during the term of her natural life.
ITEM  I give & devise to my son WILLIAM I. SMITH one Brown horse mule
about three years old except the life estate of my daughter REBECCA 
SMITH devised in a former item of this my will to have and to hold to 
him & his heirs in fee simple forever.
ITEM  I give & bequeath to SARAH A. SMITH daughter of MARK SMITH
one feather bed & furniture one cow & calf to have & to hold to her &
her heirs in fee simple forever.
ITEM  I give to and bequeath  to my son HENRY SMITH one cow & calf
to have & to hold to him & his heirs in fee simple forever.
ITEM  I give & bequeath to my son WILLIAM I. SMITH one cow & calf 
which he now holds in possession to him & his heirs in fee simple
forever.
ITEM  I give & bequeath to my daughter REBECCA SMITH all of my
household furniture not here before disposed of to have and to hold to
her & her heirs in fee simple forever.
And lastly I do hereby constitute and appoint my trusty friend JESSE
BENTON My lawful Executor, to all intents and purposes to execute
this my last Will & Testament according to the true intent & meaning of
the same and every and clause thereof, hereby revoking and declaring
utterly void all other will and testaments by me heretofore made.
     In witness whereof I the said SARAH SMITH do hereunto Set my
hand and seal this 12th day of February A.D. 1870
     Signed sealed published and          SARAH (X) SMITH  Seal
declared by the said Sarah Smith
to be her last will & testament in
the presence of us who at her
request and in her presence do 
subscribe our names as wit-
nesses thereto
