Eugene Street Greensboro, NC Book I, Pages 392, 393 No. 392 John McCuiston to Tho. Lindsey Decd This indenture made the sixth day of September in the year of Christ. One thousand seven hundred seventy six between John McCuiston Blacksmith of the county of Guilford in the province of North Carolina of the one part and Thomas Lindsey of the county and province of the other part. Witnesseth that the said John McCuiston for and in consideration of the sum of one hundred pounds proc. money of North Carolina to him in hand paid by the said Thomas Lindsey at or before the sealing and delivery hereof the receipt where of is herein acknowledged hath granted bargained and aliened and confirmed & by these presents doth grant bargain and sell alien release and confirm unto the said Thomas Lindsey his heirs an assigns forever a certain tract or parcel of and premises situate lying and being in the county of Guilford and province aforesaid and bounded as follows viz. Beginning at James McCuiston South Weft Corner a W:O on a Branch of Richland Creek thence runing East eighty Roods & then beginning again at the foresaid Beginning W:O thence Runing North Eighty Roods to the Oak thence runing a South east course to the second corner containing in the whole Twenty acres be it more or less (being a tract of land granted by James McCuiston to the aforesaid John McCuiston by deed bearing the fifth day of October one thousand seven hundred and seventy [seventy was originally written then sixty written in above it.] nine and Registered in the Register Office of Rowan County in Book 7, page 171 as Reference there unto being had will more fully appear and also all roads Timber waters and appertenances whatsoever belonging to the said Twenty acres of land with the Rents and services thereof and also the estat[] title and demand whatsoever of him the said John McCuiston & his heirs of in and to the Said tract or parcel of land and premises and every part and parcel thereof To have and to hold the said tract of land with the appurtenances unto the said Thomas Lindsey his heirs and assigns to the only proper use and beheff of him the said Thomas Lindsey his heirs and afsigns forever and the said John McCuistion for himself his heirs Excutors and Adminitrators (sic) the said these Tract and parcel of land and premises unto the said Thomas Lindsey his heirs and assigns shall and will warrant and forever defend by these presents against all manner of person and persons claiming by from and under him In Witnefs wherereof the said John McCuiston hath here unto sett my hand and affixed my seal the day and year above written The Condition of the above Indenture is such that if the above bound John McCuistion his heirs & shall will and truly make or cause to be made or executed a true lawful and firm deed of Conveyance for Two hundred and forty seven acres of land (it being the remainder of a certain tract of land which said John McCuistion bought of James McCuistion as reference being had to acertain Bill of Sale from John McCuistion to the above mentioned Thomas Lindsay of the same date of these presents will more fully appear within Four months after the Earl Granville's office shall be opened or as soon as deed can be got out of said office then the abouve indenture to be void else to remain in full force and virtue As Witness my hand and seal the year and day above written Signed sealed and delivered in Presence of us John McCuistion Benjamim McFarlin The words (His Heirs) in the second line was Interlined before signed Teft Benjamin McFarlin Guilford County May Court 1777 The within deed form John McCuistion to Thomas Lindsey was proved in open court by the Oath of Benjamin McFarlin a subscribing Witness thereto and on Motion was ordered to be Registered ______________________________________________________________________ Copyright.
