All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Vivian Anderson gxlnd@aol.com November 8, 2008, 10:37 am Written: 1774 BRYAN ROARK TO WILLIAM QUAIT 640 ACRES This Indenture made the twentieth of April in the year of our Lord One thousand Seven hundred and Seventy-three between Bryan Roark of the County of Guilford and Provence of North Carolina of the one Part of William Quait of the said Provence and County of other Part Witnesseth that the said Bryan Roark for the consideration of the Sum of one hundred and eighty six Pounds current Money of North Carolina to the said Bryan Roark in hand paid by the said William Quait at or before the ensealingt and delivery of these Presents the receipt where of the said Bryan Roark doth hereby acknowledge and thereof and every Part and Parcel thereof doth hereby acquit and discharge the said William Quait his Execution of administration and every of them by these presents have given granted alienated released and confirmed unto the said William Quait and his heirs and assigns a tract of land situated lying and being on the North fork of the Alamance in North Carolina in the County of Guilford of Provence of afore said beginning at a maple at Mebane's corner and runs along his line east 64 cains to a post oak said Mebane's corner then South 100 chains to a post oak then west 64 chains to a Black Jack thence to the beginning Six hundred a d forty acres of Land all which premises are more particular described and sett forth in the Plann or Map hereunto conveyed together with all woods under woods timber and timber trees waters and water courses with the privileges of hunting and hawking fishing and fowling in and upon the premises and all mines and minerals whatsoever therein to be found (excepting and always reserving out of this present grant unto the Kings most excellent Majesty his heirs and successors one fourth part of all the gold and silver mines to be found in and upon the premises and also excepting and always reserving unto said Earl Granville his heirs and assigns one ____ or half of the remaining three fourths of all such gold or silver mines) as also the profits commodities hereditaments and and appurtenances whatsoever to the said premises belonging or in anyways appertaining or there with used occupied or enjoyed or accepted reputed taken or known as part parcel or member thereof all which premises above mentioned and described are now in the actual possession of him the said William Quait by virtue of one indenture of bargain and Sale to him thereof made for made for the term of one year bearing date the day before the date of these presents and made between the said Byran Roark of the one part and the said William Quait of the other Part and by virtue of the Statute for transfferring uses into Possession and all the estate right title interest use ____ property reversion claim and domaine whatsoever of the premises and of every Part and Parcel thereof together with all and singular deeds evidences records escripts and minimints whatsoever touching and concerning the said premises only or only any Part or Parcel thereof to have to have and to hold the said tract of Land describing the premises together. Together with the Deeds and above mentioned and all and singular other than Premises herein before mentioned meant or intended to be hereby granted alienated released or confirmed giving Part and Parcel thereof with their and every of their appurtenances unto the said William Quait his heirs and assigns to the only proper use and behoof of him the said William Quait and his heirs and assigns forever and the said Bryan Roark for himself his heirs executors and administrators doth covenant Promise grant and agree to and with the said William Quait his heirs and assigns and every of them by these presents in manner and form following that is to say that Bryan Roark at the time of the ensealing and delivery of these presents is seized of and in the said messuage and all singular other the premises in and by these presents granted bargained and sold with all and every his right members and appurtenances of a good sure and perfect and absolute estate of inheritance in free simple without any condition revision revisions or limitation of any use estate or estates in or to any person or persons whatsoever to alter change defeat determine or make void the same and that the said Bryan Roark at the time of ensealing and delivery of Presents hath just power good right and lawful authority to grant bargain sell and convey all and singular the before hereby granted or mentioned to be granted premises with their and every Appurtenances unto the said William Quait his heirs and assigns in manner and from aforesaid and that he the said Willism Quait his heirs and assigns and every of them shall and may by force and virtue of this presents at all times hereafter lawfully peaceably and quietly have hold use occupy and posses Plantation Parcel or tract of land before mentioned and all and singular the before granted premises with their and every of their right members and appurtenances and have receive and take the rents and profits thereof to his possesion and Profits thereof to his or their own proper use and behoof forever without any lawfull sett suit trouble denial interruption eviction or disburbance of the said Bryan Roark his heirs or assigns and from any other Person or Persons whatsoever lawfully claiming by from or under him them or any of them or by his or their means act or consent title interest ______ivity or procurement and that free and clear and freely and clearly examined and discharged or otherwise from time to time well and sufficiently saved and kept harmless by the said Bryan Roark his heirs and assigns of and from all and all manner of former and other gifts bargains sales leases mortgages Jointures Dower or title of Dower statute Merchant and of the Staple (?) Recognizance extents Judgements Executions uses Entails Rents and Arranges of Rents forfeitures fines issues of herediaments and of and from all and singular other titles incumberances and demands whatsoever had made committed suffered omitted or done by said Bryan Roark or his assigns or by any other Person or Persons whatsoever lawfully claiming by from or under him them or any of them except before excepted together with the Quitrents which from henceforth from time to time grow due and payable to John Earl Granville or his heirs or assigns as Lord of the fee or fees of the premises which is at the rate of three shillings sterling for every hundred acres as will appear by an indenture Deed granted and confirmed to Bryan Roark by John Earl Granville as aforementioned and further the said Bryan Roark for himself his heirs executors and administrators doth covenant promise and agree to and with the said William Quait his heirs or assigns that he the said Byan Roark his heirs executors administrators or assigns shall and will at all times during the space of eleven years may at ensuing the date hereof at and upon the reasonable request and at the cost and charges in the Law of the said William Quait his heirs or assigns make do and execute all and every such further lawfull and reasonable assurance and conveyance in the Law for the Further assuring conveying all and singular the before granted premises and appurtenances unto the said William Quait his heirs and assigns as by the said William Quait his council learned in the Law shall be reasonably advised or required provided the said Bryan Roark his heirs Executors and he be not to travel above twenty miles from his or their dwelling house to make such further assurance. In witness where of said Bryan Roark hath hereunto sett his hand affixed his seal day and year here in first above written.
