THOMAS ROSS to ALFRED MAXWELL, deed, $980, book 26, p. 12, Transfer of inherited land from his father John Ross of Guilford County by Thomas Ross of Rockingham County, NC to Alfred Maxwell of Guilford County, NC. This Indenture made the 16 day of September in the year of our Lord one Thousand Eight Hundred and Thirty Nine Between Thomas Ross of the County of Rockingham and State of North Carolina of the one part and Alfred Maxwell of the County of Guilford and State aforesaid of the other part. Witnesseth, That for and inconsideration of the sum of Nine hundred & Eighty dollars to the said Thomas Ross in hand paid by the said Alfred Maxwell at or before the sealing and delivering of these presents the receipt whereof he doth hereby acknowledge and therefore doth release assigns and discharge the said Alfred Maxwell his Executor & administrators by these presents he the said Thomas Ross hath granted bargained sold and confirm unto the said Alfred Maxwell and his Heirs a certain piece of parcel of Land Situated being and being in the County of Guilford and State aforesaid Bounded as follows -- Beginning a Black Oak Vanstory's corner running West one hundred Sixty seven and a half poles to a stake Thence north sixty poles to a Black gum & White Oak, Thence west Thirty six poles to a Branch of Haywood's In Threxler's Field Thence North one hundred thirty six poles to a Mone? (Mine)? On Threxler's line. Thence, South Six degrees East Thirty Six poles to a Post and Birch Oak Thence East one hundred and sixty seven and a half poles to an Oak near Mrs. Green's fence, Thence South Two Hundred six poles to the beginning. Containing by Estimation Two Hundred sixty five Acres Twenty one poles of Land more or less and all Houses Buildings Orchards, ways water, water courses, profits commodities hereditaments & appurtenances whatsoever to the said premises hereby granted or any part thereof belonging or any wise appertaining and the reversion and reversion, remainder & Remainders unto Issued & profits thereof and also all the Estate, Right, Title, Interest use Trust property Claim & demand Whatsoever of him the said Thomas Ross of and to the said premises and in deeds released and writing touching or in any wise concerning the same To have and to hold the aforesaid piece or parcel of land to the said, Alfred Maxwell & his Heirs and the said Thomas Ross for himself or his Heirs doth hereby covenant and agree with the said Alfred Maxwell & his Heirs that he the said Ross is seized in fee simple of the Lands aforesaid and that he will forever & defend the Right, Title & Interest in the same to the Said Alfred Maxwell & his Heirs against the claims of all person whatsoever and the said Thomas Ross for his Heirs Executors & Administrators doth covenant promise and grant and with the said Alfred Maxwell his heirs and assigns by these presents that the said Thomas Ross now of the Time of sealing & delivering those presents is Seized of a good sure perfect and in disposable Inheritance in fee simple of and in the premises hereby Bargained & Sold and that he has good power and lawful & absolutely authority to grant and convey the same to the said Alfred Maxwell in manner and form aforesaid and that the said premises now are to forever hereafter Shall remain & be free and clear of and from the former Gifts Grants Bargains, dower rights & title of dower, Judgments, Executions, Title troubles, charges and encumbrances whatsoever made done Committed or suffered by the said Thomas Ross & his heirs all and singular the premises hereby Bargained & Sold with the appurtenances unto the Said Alfred Maxwell his Heirs and assigns against him the said Thomas Ross and his Heirs and all & every other person or person shall warrant and forever defend by the presents: In Witness whereof the said Thomas Ross hath hereunto Set his hand & seal the day and year first above written Thomas Ross (seal) Signed Sealed & delivered in the presence of Noah M.
