All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Nancy Poquette npoq@hotmail.com February 16, 2007, 3:53 am Pension Application Of Philip Huiet, Nat’l Archives Series M804, Roll __, Application #R5341 Montgomery County, Ohio} On this 30th day of August, 1856, personally appeared in open court before the Probate Court ?heard in the City of Dayton within and for the county of Montgomery and state of Ohio now setting, Henry Huiet, a resident of the town of Miamisburgh in the county of Montgomery and state of Ohio, aged 62 years, who being first duly sworn according to law, doth on his oath make the following declaration in order [for himself, and his brothers and sisters hereinafter named] to obtain the benefits of an Act of Congress passed June 7, 1832: That he is the administrator of the goods, chattels, rights and credits which were of Philip Huiet, late of Montgomery County, Ohio, deceased, and that he is also a son of said deceased, and that there are living ___ children of Philip Huiet, deceased as aforesaid, whose names are as follows, to wit: Henry, Simon, Philip and Michael Huiet, sons, and Mary Resler, Fanny Loree, Catherine Starr, Elizabeth Leighty, and Sarah Eichelberger, all daughters of said deceased. That said Philip Huiet died on the 14th of May, 1846. that he left no widow, his wife having died 10 days before him. That he, the said Philip Huiet, deceased, entered the service of the United States under the following officers, and served as herein stated: As nearly as declarant can state from his own knowledge and from what information he received from his father personally, under General Gates in the company commanded by Captain Tobias Whitesell. He was drafted and entered the service in the year 1780 for a term of six months as a private, he was, and continued in actual service in said company said full term of six months, but was only partially paid. The government was still in arrears for part of said six months service. He resided in Guilford County, state of North Carolina, and on starting the service of the United States company of Captain Tobias Whitesell, he started from Guilford Courthouse in said county and state. That said six months service were performed in the Revolutionary War. He was in none of the battles, but was advancing towards the battleground of Camden and was met two miles from the battleground by the soldiers who were retreating from that engagement after the defeat of said General Gates at Camden. Said declarant cannot distinctly recollect the season of the year or the exact day of commencement of his said father’s services, but distinctly recollects of hearing his father say that it was during the warmest season of the year. That at the end of said term of six months, he was honorably discharged, but the certificate of discharge, if he ever had one, is lost. That no witness who has an actual knowledge of the service of his father, Philip Huiet, is now living to the knowledge of this declarant. That he has no record evidence of said services except a certificate from the comptroller of the state of North Carolina showing a partial payment to said Philip Huiet for said services, which certificate is hereto attached and made part of this declaration. That his father, Philip Huiet was not engaged in any civil pursuit during said term of service, that he served in the field the whole of said term of six months. That he hereby relinquishes every claim whatever to a pension or annuity, except the present and declares that his name is not on the pension roll of the agency of any other state. Sworn to and subscribed the day and year aforesaid. Henry Huiet. [The first question asking the soldier’s age and place of birth is missing.] 2nd Have you any record of his age, and if so, where is it? We have not, the records were destroyed by fire. 3rd Where were you living when called into service? Where have you lived since the Revolutionary War and where do you now live? In North Carolina, Guilford County, has lived since the Revolution until 1806 in Lincoln County of the same state. He removed from thence Illinois Grant and from there to Ohio, and died in Montgomery County of said state. My age is 62 years on the 30th day of January last. 4th How were you called into service; were you drafted; did you volunteer, or were you a substitute and if so for whom did you substitute? He was drafted for six months term into the service. 5th State the names of some of the Regular Officers who were with the troops where you served, such Continental and Militia Regiments as you can recollect and the general circumstances of your service. The captain of his company was Tobias Whitesell under General Gates. He was at Camden guarding prisoners; and at the Cowpens. 6th Did he ever receive a discharge from services, and if so, by whom was it given, and what has become of it?
