I William Burny of the County of Guilford and in the State of North Carolina being of Sound and perfect mind and memory thanks be to God. But calling to mind the mortallity (sic) of the Bodie (sic) knowing knowing that the day appointed must for all men to die and after death to judgment. Do make and ordain this my last will and testament. That do to say principally and first of all I gave and recommend my sole (sic) into the hands of the Almighty God that gave it and my Bodie (sic) to be Buried in a Disent (sic) Chrstian (sic) manner not Doubting But at the ...?... Resurrection I shall receive the Same again by the mighty power of God. And as ...?... my worldly affairs such as it hath pleased God to Bless me with I do will and bequeth (sic)and devise as follows to Wit: I gave and bequith (sic) unto my beloved wife Mary all the house hold furniture and my sorrell mare, two cows and calves to be at her own direction and I also gave her one Negroe girl Lizzy? During her natural life then to faul (sic) to my daughter Rebeccah and my said wife and her stock to be well supported of the plantation or by the proprieters during her natural life. 2nd I give and bequeth (sic) unto my son John Burney the sum of ten shillings over and above what I have heretofore given him. 3rd I give and bequeth (sic) unto my daughter Mary Wiley the sum of ten shillings over and above what I have heretofore given her. 4 I give and bequeth unto my son Samuel Burney the sum of ten shillings over and above what I have heretofore given him. 5thly I give and bequeath unto my daughter Cathren ...?... the sum of ten shillings over and above what I have heretofore given her. 6th I give and bequeath unto my son Robert Burny the sum of ten shillings over and above what I have heretofore given him. 7th I give and bequeath unto my son William Burny the sum of ten shillings over and above what I have heretofore given him. 8th I give and bequeath unto my sons David and Josias Burny the plantation whereon I now live jointly to be directed at their discretion by them the said David and Joseph paying all my said debts. 9th I give and bequeath unto my daughter Sally Spence one nigroe girl which she now has in possession. 10 I give and bequeath unto my son Adam Burny the sum of ten shillings over and above what I have heretofore given him. 11 I give and bequeath unto my daughter Peggy Thomas one nigroe girl Seal and one hundred dollars to be raised out of my Estate. 12 I give and Bequith unto my son Josias Burny my two negros Jim and Garison and one horse, saddle and bridle. 13. I give and Bequeth unto my daughter Rebecah the nigro girl Lizy at the Death of her mother and one horse, saddle, bridle valued to fifty dollars. I do further will and Bequith that my Dis... Black Smith tools and wagon shall remain on the plantation until the land can be paid for and then to be sold by my debtors and directed among my children and all the rest of my property that is not yet mentioned I do .also direct. to be sold. My ... and ... to paying the several sums of money to my children herewith mentioned. Before and the over... of money of said sales after any to be divided equally among my children - and I do hereby appoint David Thomas and my son in law Josias Burny executors of this my last will and testament. In witness whereof I do hereunto set my hand and offer my seal of the 4th Day of October in the year of our Lord AD 1823. Then came in David Thomas one of the Executors and qualified as such. Josias Burny the other Executor came into court and renounced his right of executorship.
