Will of James Denny, Sr. of Guilford Co., NC Guilford Co., NC Will Book A, page 94 Recorded 10 Dec. 1790 Probated Feb. 1795 In the name of God Amen, This Tenth day of December in the year of our Lord One Thousand Seven hundred and Ninety. I James Denny of the County of Guilford in the State of North Carolina Farmer; being in a weak state as to bodily Health; but of perfect mind and Memory thanks be to God therefore, and calling to mind the Mortallity [sic] of my body and that it is appointed for all Men once to die do make and ordain this my last Will and Testament, that is to say principally, and first of all I give and recommend my Soul into the hands of God who gave it, and my Body I recommend to the Earth to be buried in a Christian like and decent manner at the discretion of my Executors not doubting but at the general Resurrection I shall receive the same reinstated to my Soul by the Mighty power of God, and as touching such Worldly Estate wherewith it hath pleased God to bless me in this life I give Bequeath and dispose of in the following manner and form And first I give and bequeath unto each of my Married Children (viz) Mary Duck, Ann Ross, Maryanne Peasly, George Denny, Jane Hamilton, Agness and Elizabeth Donnell and James Denny, one Dollar each, First, I give the loan of Five Pounds to my son James for Eight Years without Interest and at the end of Said Term I allow him to pay Said Sum to my Grandson James Denny, George Denny's son, Secondly, I give and bequeath to my Daughter Hannah her horse and Saddle two cows and Six Sheep, one bed with its furniture one chest fifteen pounds of pewter and one Iron Pot, Thirdly, all that remains of my Estate from the above Bequeathments I allow Agness my Wife and William my Son to have an eaqual [sic] Interest during the time of her Natural life and at her discease [sic] I allow her part to become his property together with the Plantation on which I now live with its Appurtenances which I give and Bequeath to my Son William Denny his Heirs and Assigns forever; But if my dear Wife would chuse [sic] rather to live with any other of her Children I allow her to have her Mare and Saddle her Bed and Wheel and Five Pounds in Money Each year during her life, And if any Money remains after my debts are paid it shall be hers and at her death she may leave these Articles to whom she wills; Lastly, I do hereby constitute make and ordain William my well beloved Son and John Donnell my respected and trusty friend and Son in Law Exetutors [sic] of this my last will and Testament, And I do also hereby utterly disallow revoke and disannul all and every other former Testaments, Wills, Legacies, Bequeaths and Executors by me in anywise before this time Named Willed and Bequeathed, Ratifying and confirming this and no other to be my last Will and Testament, In Witness whereof I have hereunto set my hand and Seal the Day and year Above Written James Denny Seal Signed Sealed Published Pronounced and Declared by the Said James Denny as and for his last Will and Testament in the presence of us the Subscribers. John Rankin Joseph McGaughy Charles Wheeler Jurat and that he saw John Rankin become a witness at the same time State of North Carolina February Court 1795 Guilford County The Execution of the with[in] Will was proven in open Court By the Oath of Charles Wheeler one of the Cubscribing [sic] Witnesses and also that he saw John Rankin Sign as a Witness at the same time then William Denney and John Donnel came into Court and qualifyed [sic] as Executors of the same agreeable to Law & c Test John Hamilton Clerk
