I, James Petty of the County of Guilford and the State of North Carolina, being at this time in a low state of health but of sound mind and memory, and calling to mind the uncertainty of life and the certainty of death, do make this my last will and testament and First, it is my will that my remains be decently buried and all expenses attending the same together with all other just claims that may be exhibited against my estate be punctually paid. Secondly, I will and bequeath all the residue of my estate both real and personal to my beloved and affectionate brothers, namely Watson Petty, Samuel Petty & William Petty to be divided equally among them share and share alike. But should any of my brothers not survive to full age so as to take possession of said property it is my will that his share shall be equally divided among his surviving brothers. And lastly I ordain and appoint by trust friend and affectionate brother Watson Petty my executor to this my last will and testament. The Executor of the within will was prov’n in open court by the oaths of Jonathan Anthony & William Worth, the subscribing witnesses thereunto on motion ordered to be recorded.
