I, Elias Petty of the County of Guilford and State of North Carolina being at this time in a bad state of health but of sound mind and memory and calling to mind the uncertainty of life and the certainty of death, do make this my last will and testament, and First, I direct that so much of my property shall be disposed of at the discretion of my Executors as may be found necessary to discharge all just claims against my Estate. Secondly, I will and devise unto my beloved wife Rachel Petty all my other Estate both personal and Real to her entire use and benefit for her support and maintainance [sic] during her natural life or widowhood, at the expiration of which time it is my will that all my property that may remain be sold and the proceeds equally divided between my five children, to wit, Watson Petty, Polly Hodson, James Petty, Samuel Petty & William Petty. Except one bed and furniture which I give and bequeath unto my beloved wife at her entire disposal forever together with such other articles of household furniture as I acquired by my intermarriage with her. It is further my will that if any of my above-named children should not arrive to full age that his or their portion or portions shall be divided among the surviving share and share alike. And lastly I ordain and appoint my worthy friends William Worth and Watson Petty my executors to this my last will and testament. Signed in the presense of David Worth and Eunice Worth this November the first 1825. Elias Petty (his mark) State of North Carolina, Guilford County, Nov. Term, 1825. The Executors of the within will was prov’n in open court by the oath of David Worth, subscribing witness, ordered to be record, thus Watson Petty, Executor appointed in said will came in & qualified.
