The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. ****************************************************************************** [Will - Guilford County Will Book A, page 375] I, Matthew Starbuck of Guilford County, State of North Carolina, being of sound mind and disposing memory, do make and ordain this my last will and testament in manner and form following, It is my will that all my just debts and funeral expenses be paid. And first I give and bequeath unto my beloved wife Dinah Starbuck the use and profits of one third part of my plantation with every privilege thereto belonging during her widowhood - also one third part of my dwelling house for her to have full privilege to use and to occupy in any manner she may think best and for her to have all the wearing clothes -- beds and furniture and every article she had when I married her that is now in being, also I give unto her two pair of sheets of the common sort and one good pair of home made blankets, she is also to have the use of my stage wagon while she continues my widow and continues on my plantation -- it is also my will that the one third part of my income of my plantation does not afford a sufficiency for my wifes support that my Executors furnish her with what they may think best out of my estate but if my wife should incline to marry my will is as soon as she doth that she have her wearing clothes as above mentioned with her bed and furniture and all other articles she had when I married her that are now in use I give to her forever. 2nd. I also give unto my son Reuben Starbuck twenty dollars with what I have here to fore given him to him and his heirs forever. 3rd. I also give unto my four sons (namely) John, George, Charles and Benjamin Starbuck all my land that I own in Guilford County No. Carolina to be equally divided between them provided they pay twenty dollars to my son Reuben as above mentioned for them to pay it equally and if any of them die in minority or without heir of body for their part to devolve to the surviving brother or brothers as the case may be. I give it to them and their heirs forever. 4th. I also give unto my daughter Eunice Gardner five shillings with what I have here to fore given her toi her and her heirs forever. 5th. I also give to unto my daughter Mary Starbuck fifty dollars to her and her heirs forever. I also give unto my daughter Elizabeth Gardner fifty dollars to her and her heirs forever. I also give unto my daughter Sallay Coffin fifty dollars to her and her heirs forever. I also give unto my daughter Lydia Wheeler fifty dollars to her and her heirs forever. I also give unto my son Charles my desk and the horse colt that is now called his to him and his heirs forever. I also give to my son Benjamin my watch to him and his heirs forever. And it is my will that my farming utensils of what name or nature soever be equally divided among my four sons namely Seth, George, Charles and Benjamin Starbuck -- also for George, Charles and Benjamin to have each of them a silver spoon each spoon is marked in the two first letters of their names that is G.S., C.S., and B.S. I give to them and their heirs forever. And all the residue of my personal estate of what name or nature so ever, I give unto my six daughters namely Eunice, Mary, Elizabeth, Sallay, Lydia and Avice to them and their heirs forever. And lastly I do constitute and appoint my two sons Seth and George Starbuck joint Executors to this my last will and testament revoking and disannulling all other wills by me made ratifying and confirming this and no other to be my last will and testament. In witness where of I have hereunto set my hand and seal this 14th day of the first month 1815. Matthew Starbuck (his seal) Signed, seald and acknowledged by the said Matthew Starbuck to be his last will and testament in the presence of Barnabas Coffin, William Starbuck (Jurat), Paul Starbuck. A Codicil to the Within Will. Be it known to all men by these presents that I Matthew Starbuck of Guilford County, No. Carolina have made and declared my last will and testament in writing bearing date 14th day of the 1st month -- I the said Matthew Starbuck by this present codicile do ratify and confirm my last will and testament and do further give unto my beloved wife Dinah Starbuck while she remains on my plantation and continues my widow the use of two of my horses to go in the stage wagon when it appears convenient for her to ride from home, also the use of two cows and if she should marry for her to have one of them and the other to go into the residue of my estate -- it is also my will for her to have the use of one spare bed and furniture during the time she continues at my house. I also give one feather bed and furniture to my three sons (namely) George, Charles and Benjamin Starbuck that is one bed and common furniture or value there of to be equally divided between them -- and I also further give unto my daughter Avice one cow with what I have here to fore given her. And I further give unto my son Benjamin Starbuck the use of my mare called Cate that he had new put to the horse till he can raise a colt from her -- and after the colt is weaned for said mare Cate to go with the residue of my estate. It is my will and meaning that I want it so to be understood that all the articles above mentioned in the codicil for the use of my beloved wife Dinah be at her command and for her use during her continuance at my house as my widow but if she should move to some other place as her home for the above mentioned articles to go into the residue of my estaste. And my will and meaning that this present codicil be judged to be a part and parcel of my last will and testament and that all things there in mentioned and contained be faithfully and truthfully performed, and as fully and amply in every respect as if the same were set down in my last will and testament as witness my hand and seal this the 21st day of the 6th month 1815. Matthew Starbuck (his seal) The within will and codicil acknowledged by the said Matthew Starbuck to be his last will and codicil in the presence of Barnabas Coffin, William Starbuck (Jurat), Paul Starbuck. State of North Carolina -- Guilford County February term 1816. The execution of the within will was dually proved in open court by the affirmation of William Starbuck one of the subscribing witnesses there to and on motion ordered to be recorded.
