I Thomas Davis of the County of Halifax & in the Province of North Carolina, being at this present of sound and disposing mind and memory and calling to mind the mortality of man, do make and ordain this to be my last Will and Testament hereby revoking and annulling all other Wills by me formerly made. Imprimis I recommend my Soul to God who gave it me and my Body to the Earth at the Discretion of my Exrs hereafter named. Item I give [devise ?] and bequeath to my son Frederick Davis and his heirs for ever my two upper Tracts of Land upon Sandy Creek in Bute County patented in my own name, also one hundred and thirty two Acres of Land joining the afsd land on the South Side, being a Tract of I bought of John Watson, and also one hundred acres of Land that I bought of John [Lincil ?] joining the said Lands. Item I give, Devise and bequeath to my son Goodwen Davis and his Heirs for every my Land and plantation whereon William Davis now lives, lying in Halifax County containing two hundred acres and the Land thereunto adjoining patented by my self and also seven hundred acres of Land lying in Bute County adjoining Daniel [Nance ?]. Item I give the use of my mannor Plantation containing seven hundred and eighty one acres to my loving wife during her natural Life or Widowhood with Privilege of [entering ?] and clearing Land and [illegible] either advantage which she shall think proper to make use of and at her decease I give & Devise and bequeath the Land to my son Dolphin Davis and his heirs for ever and also my large still during the Life of my Wife I lend her the use of and after her Decease I give the Same to my said Son Dolphin. I also give and bequeath to my said son Dolphin Davis and his heirs for ever one hundred acres of Land lying in the County of Halifax, adjoining my Manner Plantation, also one Tract of Land patented in my own Name, lying part in Edgecombe County and Part in Bute County, adjoining James Ransom George Portis & Lewis Davis. Item I give devise and bequeath to my son Thomas Davis and his heirs for ever my Plantation on the North Side Creek that I bought of John Watson in Bute County contain one hundred and seventy acres of Land, and also One plantat [sic] adjoining the same on the South Side said Creek in the said County containing one hundred and seventy acres of Land also on plantation containing one hundred acres of Land bought of Arthur Watson adjoining the said Land on both sides the said Creek also seven hundred acres of Landed patented in my own Name lying in the same County adjoining the said Lands and Benjamin Wheelis on the North side of the aforesaid Creeks also six hundred and and [sic] forty acres of Land lying on the [North ?] side Red [Reel ?] Bend Creek adjoining Robert Hill in the aforesaid County & bought of John Watson. Item I give and bequeath to my son Arch Davis and his heirs for ever all that Tract of Land that I bought of John [Fluer ? Huer ?] patented in my name and also all the remaining part of the said Tract, contained in the same Patent lying on [White ?] [Creek ?] [illegible] part in Edgecombe and part in Bute County, also all my Land lying in Edgecombe County and that is patented in my own Name and not before given or disposed of. Item I give devise and bequeath to my son Orindatus Davis and his Heirs for ever all the rest of my Lands not before [devised ? devided ?]. Item I give and bequeath to my Nephew Dioclecian Davis son of Lewis Davis one Negroe Girl named [Tolar ?] her Increase I [say ?] to him and his Heirs for ever. Item I give and bequeath to my Daughter Sally Davis one Negroe named [Pink ? Jink ?] and her increase are I [pay ? say ?] to her & her Heirs for ever. Item I leave the use of four Negroes, to with Dick & David Rose and [Mary ? Aary ? Amy ?] to my loving Wife Hartwel during her Natural Life and also the use of the Increase of the said Negroes Rose & [Mary ? Aary ? Amy ?] during her natural Life and after her Decease I desire the said four Negroes Dick and David Rose & [Mary ? Aary ? Amy ?] and their Increase to be equally divided among my children or their legal representatives. Item And my Will and Desire is that all the rest of my Personal Estate not before disposed of may [illegible] together and [illegible] the Profits thereby arising to be applied towards the Support and Maintenance of my loving Wife and the Support and Education of my children and in case my Wife should marry then I desire that all my house hold goods and furniture should be equally divided between my seven children & my loving wife that is to say in eight equal Parts and when either of my children shall arrive at the age of twenty one years or marry then my Will and Desire is that all the rest of my personal Estate of what Nature or kind since not before mentioned shall be equally divided to and amongst my seven children or their legal representatives Or in case my said Wife should marry then I desire the aforesaid Division should be [illegible] in the same manner as if either of my said seven children had married or arrived to the age of twenty one years. Item I give and bequeath to my Brother Lewis Davis Ten pounds Virginia Money to be raised out of the Profits of my personal Estate. Item I give and bequeath to my friends Maj Joseph Montfort and my Friend Blake Baker [word scratched out] thirty Pounds Virgn money for their trouble in acting as Exrs to be paid out of the Profits of my personal Estate. And I do hereby nominate my Brother Lewis Davis & my trusty and beloved Friends Joseph Montfort & Blake Baker Exrs of this my last Will & Testament in [illegible] whereof I have hereunto set my Hand & seal this 29th Day of September Anno Dom 1764 The mark of D Thomas Davis Sealed published [two words scratched out] pronounced & Delivered in presence of Samuel Davis Abraham Green Jno Green Thomas Mason.
