Will of Jacob Wyatt

In the Name of God Amen.
The twenty eight Day of January in the year of our Lord one Thousand seven 
Hundred and sixty one, I Jacob Wyatt of Halifax County Being very sick in Body 
though in my perfect mind and Memory and my proper senses Blessed be God  
first and therefore calling to mind the Mortality of my Body and knowing it 
is appointed for all men once to Die Do make and ordain this my Last Will and 
Testament, that is to say and Principally and first of all I Recommend my soul 
in to the of God that gave it to me and for my Body, I Recommend it to the 
Earth to be Buried in a Christian – Like Manner and Decent at the Discretion 
of my Executors nothing Doubting but at the General Resurrection I shall receive 
the same aGain by the might Power of God and as Touching such things as my 
Worldly Estate which God hath Been Pleased to Bless me with in this Life. I 
Give Divide & Dispose of the same in the following manner and form – 

Item, I Give and Bequeath to my two Daughters Rhoda Wyatt and Mary Wyatt my 
property to the Half of my new entry of Land in Edgecombe County Lying on the 
North Side of the Beaverdam Swamp to be Equeally Divided Between them and money 
to secure the whole tract, my Desire is that Rhoda shall have the Land to 
Begin at the Lower Corner and for Mary’s to joine it.

Item, I Give and Bequeath to my son Jesse Wyatt the Plantation where I now Live 
Containing one Hundred and ten acres of Land and also my property to three 
Hundred Acres of land Which is part of my new survey which is in the middle of 
the survey which Land is in Halifax County Lying Both sides of the Gum Swamp 
which property of mine I Give to him and his heirs forever and also money to 
secure the whole Tract, and also my Riffel Gun.

Item I Give and Bequeath to my Daughter Christiania Wyatt the sum of Twelve 
pound prov. Money to be reserved for her by my Executors till she comes of Age 
– and then all my lawful depts. to be paid and all the rest of my _________ 
[indecipherable word] Estate Land to my wife Mary Wyatt During the time of the 
Life and Widowhood and after wards the Third part I Give to Her, to be her 
property and the Rest that Remains to be Equeally Divided amongst my Children.

I likewise Constitute make and Ordain my Father Loving Father James Wyatt and 
my Brother James Wyatt my Only Sole Executors of this my Last Will and 
Testament and I do hereby utterly Disallow, Revoke and Disannul all and Every 
other Testaments, wills, Leagacies, and Executors by me or in any ways before 
named willd and Bequeathed Rattifying and Confirming this and no other to be 
my Last Will and Testament.

In Witness, whereof I have hereunto set my hand and seal the Day and [date]

This Will was Exhibited I open Court and proved by the Oath of Francis Spivey, 
one of the subscribing witnesses thereto, and at the same Time James Wyatt one 
of the Executors therein named came in to Court & was Duly Qualified According 
to Law – and on motion ordered to be Recorded...
