Devised December 16, 1899 Registered January 3, 1903 State of North Carolina Harnett County I, Neill Barnes of the County of Harnett and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say: First, that my Executors herein after named shall provide for my body a decent burial suitable to the wishes of my friends and relations, pay all expenses together with my just debts to whomsoever owing out of the money that may first come into their hands as part of my Estate. Item, I give and devise to my eldest son J. W. Barnes one dollar as his own right and property forever to be paid by my executors within two years from the time of my death out of any money belonging to my estate not otherwise disposed of which with the advances heretofore made will be an equitable share of my Estate. Item, I give and devise to my son B. T. Barnes one hundred acres of land off the north end of my 300 acre tract on Thornton's Creek as his right and property forever provided he shall properly provide for and take care of my little Grandson Chester A. Arthur Barnes until he becomes 21 years old. If the said Chester A. Arthur Barnes should die before he becomes 21 years old the said B. T. Barnes shall have the entire 300 acre tract of land above named. Item, I give and devise to my little grandson Chester A. Arthur Barnes 200 acres of land off the south end of my 300 acre tract on Thornton's Creek to be his right and property forever. Also the personal property which was claimed by his mother. Item, I give and devise to my son Neill A. Barnes my home tract of land consisting of 300 acres except two acres including the dwellings and smoke house to be his right and property forever. Item, I give and devise to my little grandson Chester A. Arthur Barnes 2 acres of my home tract of land to include the dwellings and smoke house to be his own right and property. Item, I give and devise all my personal estate to my son Neill A. Barnes of whatever it may consist at my death to be his own right and property forever. And lastly I do hereby constitute and appoint my sons B. T. Barnes and N. A. Barnes my lawful executors to all intents and purposes to execute this my last will and testament according to the true extent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. In witness whereof I the said Neill Barnes do hereunto set my hand and seal the 16th day of December 1899. Neill Barnes Signed, sealed, published, and declared by the said Neill Barnes to be his last will and testament in the presence of us who at the request and in his presence do subscribe our names as witnesses thereto. Wiggins State of North Carolina Harnett County In the Superior Court A paper purporting to be the last will and Testament of Neill Barnes Decd. is exhibited before me the undersigned Clerk of Superior Court to said County by B. T. Barnes and N. A. Barnes the executors therein mentioned and the due execution thereof by the said Neill Barnes by the Oath and examination of S. R. Wilson and Sarah C. Wiggins. The Subscribing Witnesses thereto: who being duly sworn doth depose and say and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Neill Barnes. That the said Neill Barnes in the presence of these deponents subscribe[d] their names at the end of said paper writing which is now shown as aforesaid and which bears the date 16 December 1899. And the Deponent[s] further saith that the said Neill Barnes the Testator aforesaid did at the time of subscribing his name as aforesaid declare[d] the said paper writing [to be his last will and testament and] so subscribed his name to the said last will as aforesaid. And at the time [of the] Deponents subscribing their names as attesting witnesses thereto as aforesaid, the said Neill Barnes was of sound mind and memory, of full age to execute a will and was not under restraint to the knowledge, information or belief of these Deponents and further these deponents say not. S. R. Wilson Sarah C. Wiggins North Carolina Harnett County In the Superior Court It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the last will and testament of Neill Barnes Deceased.
