Haywood County, NC - J.A. & Mary H. Francis to John & Catherine Dyer, 1904 ~~~~~~~~~~~~~~~~~~~~~~~~~~ State of North Carolina, Haywood County}} This deed made this 1st day of Jan A.D. 1904 by J.A. Francis and Mary H. Francis of the county of Haywood, State of North Carolina, to John Dyer and Catherine Dyer and the children of John Dyer by Catherine after their death, of the county and state aforesaid. Witnesseth that the said J.A. Francis and Mary H. Francis his wife in consideration fo the sum of ($77.00) seventy seven dollars to them paid by the said John Dyer and Catherine Dyer, the receipt of which is hereby acknowledged, have bargained sold and conveyed and by these presents do bargain sell and convey to the said John Dyer and Catherine Dyer and the children of the said John Dyer by Catherine after their death, a certain tract or parcel of land in said county of Haywood state of North Carolina, situated in Waynesville Township, Haywood County on a branch of Raccoon Creek now adjoining the lands of Henry Liner, J.N. Ratcliff and others, bounded as follows:" [Note: Before continuing with the description of the land it is important to note that the twice-repeated phrase "and the children of John Dyer by Catherine" has been deliberately squeezed in between the lines preceding and following the phrase on the original document, likely purpose of which was to differentiate between the children of John Dyer by his deceased first wife, Rebecca Sorrells, and children of his second marriage to Catherine Chambers. - M. Styles] Continuing: "Beginning on stake 5-1/2 poles north of a branch in Henry Liner's line running south crossing the branch 31-1/8 poles to a black oak old corner, thence south (?) east 16 poles to a small sourwood, thence north 36 poles to a stake on south side of a branch, thence south (?) west to the beginning containing three acres and fifty-six one hundredths." "To have and to hold with all privileges and appurtenances thereto belonging to the said John Dyer and Catherine Dyer and the children of John Dyer by Catherine Dyer after their deaths, assigns to them and their only use and behoof forever and the said J.A. Francis and Mary H. Francis covenant that they are seized of said premises in fee and has the right to convey the same in fee simple and that the same is free from all encumbrances and that they will warrant and defend the said title to the same against the lawful claims of all persons whatever." [Notes: The deed is marked, Filed March 19, 1904 at 3 o'clock pm, Registered March 19, 1904, Deed Book 18, page 475, J.M. Mease, Register of Deeds. The original of that deed is in the possession of Robert D. Milner of Old Fort, NC, a direct descendant of both grantors and of both grantees. James Albert Francis and his wife Mary Haseltine Davis Francis were the parents of Flora Jane Francis who had married John and Catherine's son Jeremiah Hascue Dyer, and were living just three houses from each other in Ratcliff Cove in 1900. John Dyer, a Confederate Veteran, was born in Lincoln County, NC, the son of Archibald Dyer and Mary Robertson. His first wife, Rebecca Catherine Sorrells – daughter of William Sorrells and Jane Morrow, died in Ratcliff Cove about 1871. ______________________________________________________________________ Copyright.
