Scates, 23 Apr 1929 ----¤¤¤¤---- "State of North Carolina: Haywood County}} This deed, made this 23rd day of April A.D. 1929, by Jane Mitchell, widow, Katie Morris [her daughter] and husband H.L. Morris, T.P. Mitchell [her son] and wife D.M. Mitchell, of Haywood County, of the first part, to J.P. Scates of Haywood County of the second part; Witnesseth, that said Jane Mitchell, Katie Morris and husband H.L. Morris, T.P. Mitchell and wife D.M. Mitchell, in consideration of ten dollars and other valuable considerations, to them paid by J.P. Scates, the receipt of which is hereby acknowledged, have bargained and sold, and by these presents do grant, bargain, sell and convey to said J.P. Scates, his heirs and assigns, a certain tract or parcel of land in Waynesville Township, Haywood County, bounded as follows, viz: "Beginning at a stake at the intersection of Mississippi Avenue with State Highway 10 and runs thence with the northern margin of Mississippi Avenue N 88 degrees W 190 feet to a stake at the southeast corner of lot No. 22, thence N 2 degrees E 165 feet to a stake, thence S 88 degrees E with the line of lot No. 37, 53 feet to a stake in the line of lot No. 20; thence with the line of said lot No. 20, S 25 degrees 45 W, 57 feet to a stake, corner of lot No. 21; thence S. 72 degrees 15 E 185 feet to a stake at Highway No. 10; thence with same, S. 17 degrees W 65 feet to the beginning, being lot No. 21 and a portion of lot No. 22 in Block "C" of Brookwood, as per survey and plat of J.W. Seaver. "Being the same property described in two deeds to Jane Mitchell, one from John R. McClure and wife for said lot No. 21, recorded in Book 55, page 589, and the other for the portion of lot No. 22 in a deed from Seymour Clark and wife recorded in Book 57, page 42, Record of Deeds of Haywood County. The sale of this property is made upon the express condition that the said party of the second part is not to sell or lease said property to Negroes or persons of Negro blood, and if they do, this deed is to become null and void and the property revert to A.C. Fongue (?), her heirs and assigns. "To have and to hold, the aforesaid tract or parcel of land and all privileges and appurtenances thereto belonging, to the said J.P. Scates, his heirs and assigns, to his only use and behoof forever. And the said Jane Mitchell, Katie Morris and husband H.L. Morris, T.P. Mitchell and wife D.M. Mitchell, for themselves and their heirs, executors and administrators, covenant with said J.P. Scates, his heirs and assigns….
