HAYWOOD COUNTY, NC - DEEDS - Jane Mitchell to J.B. Mitchell, 22 Apr 2003 ----¤¤¤¤---- "State of North Carolina - Haywood County}} This deed, made the 22nd day of April A.D. 1929 by Jane Mitchell, Widow, of Haywood County, of the first part, to J.B. [James Burton] Mitchell of Haywood County, of the second part: Witnesseth, that said Jane Mitchell in consideration of ten dollars and other valuable considerations, to her paid by J.B. Mitchell, the receipt of which is hereby acknowledged, has bargained and sold, and by these presents does grant, bargain, sell and convey to said J.B. Mitchell, his heirs and assigns, a certain tract or parcel of land in Waynesville Township, Haywood County, as follows, viz: "Beginning at a stake on the north side of Mississippi Avenue corner of lots Nos. 21 and 22, and runs with said avenue N. 88 degrees W 65 feet to a stake, corner of lot no. 23; thence with that lot N. 2 degrees east 165 feet, thence S. 88 degrees E 65 feet to a stake; thence S. 2 degrees West with her line 115 feet and continuing with the same course 50 feet further, to the beginning. Being a portion of Lot no. 22 of Brookwood survey at Hazelwood, as per survey and plat of J.W. Seaver. "Being the same lot or parcel of land described in a deed from Seymour Clark and wife Mattie Clark to Jane Mitchell dated January 7, 1922, and recorded in book 57 page 569, Record of Deeds, Haywood County. The sale of this property is made upon the express condition that the said party of the second part is not to sell or lease said property to Negroes or persons of Negro blood, and if they do, this deed is to become null and void and the property revert to A.C. Fongue (?), her heirs and assigns.... In Testimony Whereof, the said Jane Mitchell has hereunto set her hand and seal, the day and year first above written. Jane (her mark) Mitchell {Seal}. "Filed for registration at 1 o'clock P.M., Apr 22, 1929, and registered in the office of the Register of Deeds for Haywood County, in Book No. 77 of Deeds, page 537, this 23rd day of April, 1929." The following day, James Burton Mitchell and his wife sold this piece of property to J.P. Scates. Recorded Deed Book No. 77, page 539, April 23, 1929.
